Well, I have no idea how it works with continuity and movie production, but legally, it's a load of nonsense. Copyright covers actual art - plot, characters, setting (dubiously), stuff like that. Copyright does not cover concepts and ideas, so even if Marvel did pass some "rights" to the idea...
