So let's see:

Situation 2: My cousin does heroin and finds himself deported from the United States, he isn't allowed to go back.

Please clarify what I'm obviously missing here.

Country of origin is actually fairly relevant here. In the sense of being born in the US versus being born anywhere else.

Mental tests also say a lot. To get insanity, a therapist must see some kind of problem for the plea. If none can be seen, or they are obviously faking, that throws out any insanity plea a person may have due to lack of proper information.

Not saying its fair, just working from something closer to their view. That really is a pretty stupid circumstance.

Their job is to persecute innocent people, with solid alibis when there are rapists and murderers walking the streets?

Good point. I doubt the guy just skipped on home to plot his next victim. He's probably not much better off than he'd have been if he had life imprisonment, though I may be wrong.
