Let me put this in perspective and keep it short...

This is MY computer
I built it
I paid for the parts
almost every piece of this is MINE!

...my mom says that it's hers and she allows me to use it, and she constantly threatens to take it away!

Sure it was hers originally... but after she killed it with a virus and said "you can have it" and I replaced EVERY PART OF IT. she wants it back?

Mind you Yes I'll admit, the Plastic Shell casing and the CD-drive are hers... but the DVD drive, the RAM, the processor, the video card, the motherboard, the speakers, the headset, the hard drive, and 99% of the installed files (everything but Bookworm, The Sims, and WordPerfect)

ARE MINE! and came out of MY POCKET

...note I'm 18

another note, yes I did feel like posting this after reading about that kid and his facebook problem with his mom

...oh and the anti-virus software that keeps finding things from her facebook clicking is also mine, and she dosen't even know how to use the anti-virus software, she thinks "It works by itself and scans every day"

...yeah well WHO set it to do that?

If you still live in her house and it was originally hers, its hers. Also whats with all these "my mom is" threads today?

If so much of it is yours, remove the ram dvd drive processor and video card and make a new one perhaps? That way ownership is irrefutable.

Give her an empty case and a cd drive and say "Heres your computer".

If she actualy takes it away add passwords to EVERYTHING (and write them down somewhere) and use the most confusing settings options on your computer.

Do what I used to do when my sister would try to take my stuff when we were kids. Just lick the computer. Then your mom will be too grossed out to touch it.

Seriously, though, just try having a rational discussion with her.

wow she sounds kinda greedy, It should be yours if she gave you a shell and you turned it into a computer. I hate when people claim ownership of something that someone else made.
you have no idea how hard I'm resisting the urge to say "OH NO, where will you get your porn now?"
but it should be yours and your an adult, free to make your own choices.

You could give her the parts that are originally hers. Your DVD drive should read CDs anyway, meaning really you'd just need a case, she'd need everything, and if she's being at all reasonable she can't claim you're keeping her stuff. Or you could do it the easy way and just explain to her that it's pretty much entirely yours.

But I do agree with most people, it is yours and you did practically build it. If your mother tries to claim ownership of it have an intelligent conversation or just pick it up and walk out of the house with it and either:

1) Smash it on the ground and laugh in her face.
2) Say "I paid for the drink holders of the car, they're mine now!" and drive away.
3) Move into your own apartment and never look back.
4) Do option one but then say "Oops, butterfingers" then laugh.
5) roll on the ground screaming "It's mine" and "Why didn't you just have an abortion!"
6) rip out the parts that are hers and throw them at her house.
7) give her the case of the computer with rocks or something inside so it feels heavy, then leave and wait for her to get pissed about you stealing.
8) Spit in her eye and walk away.

I personally like number 3 and 1 but it is your choice.

Hmmm... this is a tricky one, indeed.

I would be inclined to say that it's now your computer if she basically gave it to you after the virus hit it, but then again, there is a tendency of one side in these types of arguments to not tell the whole story. It seems like a situation like with game consoles when I was growing up. Because the consoles used a family television, we were only allowed to play at certain times of the day. Same thing with the computer. No one person in our family owned it, we all shared it. So why not just share your computer? When you move out of the house, buy or build one for yourself then. Heck, if you save up enough money, you could probably make a better one than the one you've got now.

I would argue she can take it away in the sense that she pays for the electricity. Other than that we have a <a href=http://en.wikipedia.org/wiki/Ship_of_Theseus>Theseus Paradox on our hands. Oh wait, no we don't because we have ownership laws now. According to the law it is hers.

If she said "Here, you can have it" in a rational manner (not a "Take this thing away from me because I'm so angry at it right now" way), then it's yours.

However, if she won't let up, just say "Well, that's fine, you can have it back". Then give it back, after having taken out all of the parts that you completely paid for. Obviously, explain why you took those parts out. Considering you say you've upgraded nearly everything in the machine, it shouldn't cost you too much to buy the rest of the parts you need to have a PC that you 100% owned, built and paid for.

Go biblical on her ass and offer to cut it in half.

You are legally an adult who lives in her house, she can do what ever she wants. I would say that you need to sit down with her and talk about it in a reasonable and calm manner like two adults. On the other hand, you could always just throw a gigantic hissy fit. Although it's extremely juvenile it's also fucking hilarious.

According to what law? If he's replaced a significant amount of parts on his own (and has receipts to show) no claims court would say he should give it back. They'd say he should pay her for the costs of the remaining parts, at most.
