Question regarding release forms and audio recordings

I have searched and searched and cant find anything specific to audio recordings just video so i wanted to see if anyone here had incite.

I recently filmed a seminar in halifax Canada for the establishment owner and after the seminar was done the guest speaker took questions.the people asking questions are not visible in the video and are barley even audible, yet the guest speakers agent is worried I would be legally infringing on the question askers if i publish the footage of the speaker (only the guest speaker is visible).

I personally thought that it would fall into the realm of the questioners not being "readily identifiable" in legal terms.

You can be identified by voice legally so its that counts as readily identifiable. That said if they went to a seminar which they knew was being recorded and asked a question you could argue consent by deed. The argument is that it is fair and reasonable to assume consent by the act of volunteering to ask a question. There is also the practical question will anyone care enough to make an issue of it.
