i can already answer that 1. Nintendo did. nearly all the mario games past the SNES had that quote in the game.

To your first question, there is no answer. That's why it's a paradox. One can assume that a tree makes a sound but if the sound goes unheard then you're taking a lot for granted.

Ostriches could fly once upon a time (Land => Air => Land). Just like the whales ancestor walked on land (Water => Land => Water). They simply returned to a earlier stage since it was... better in some way i guess.
