Mafia I had some flaws as well, aggrevating 'steal the racecar without damaging it under x minutes' mission and pedestrians crossing the highway every single time as you drive by.. There are some gameplay videos of the preview on gametrailers here...

I think drinking is alot more dangerous then smoking.
