I'll just say this, I lost my virginity when I was 8 or 9. That's right 4th grade was all about sex for me, a female classmate and her sister. I can say kids can understand sex at that age, so much so, that it was rare in Elementary school for me to not hear about a guy getting at least to 3rd base with a girl. By 5th grade, I contracted my first STD from a 10th grader. (I know all this sound far fetched, but please believe me, this is real and has a point.)

So for this situation, I can believe that she knew what she was doing. Maybe not fully, but to an extent. I have been that young, doing worst shit, and enjoying it. But she is still young, still learning. Even if she did understand what was happening I do not believe she should be charged with anything. Tell her parents, have them punish her, maybe have a police officer visit to explain how people go to jail for stuff like that all the time. She is still at an age where this is all new this is a time for learning, not condemning.

No, this does need some action by the state. Penitentiary isn't the thing for it though. This child needs social services intervention. Look into her family and get her a Psychologist, because there is NO reason a 10 year old should be -curious- about that shit at all. It should have been mostly demystified several years prior.

I would accept this as "Exploration" if she was doing that with someone closer to her age, or if she did it before she was school age. At 10 years old you're old enough to know that shit isn't acceptable.
Sexual curiosity is quite common among kids. For instance I read more and more cases of toddlers in pre-school "experimenting". And while it's less "sexual" and more of a "I wanna know more about what you have down there because I don't have it" kind of thing, the curiosity is there. And psychologists even note that people are actually also blowing things out of proportion because that has always existed, there is simply much more transparency about it (easier flow of information and consequently people are more likely to hear about it when it happens). I even once read an article about a group of cub-scouts (9-11y old) playing sex-games when their supervisors left them unsupervised in a dorm (they didn't expect that to happen and it was nap-time).
Now sure it's weird that in this case it involved someone much younger but most kids don't have that notion of "consent" and maturity as older people have.

So...from what I'm garnering from this article, without asking neither two children how they ended up in this situation, the girl gets charged for rape.

At this stage of a kids' life, it is very VERY possible that she doesn't know what a dick looks like, and the boy- equally ignorant of such things was willing to show her and she played around with it. (It can even be assumed that the girl showed her vagina to the boy earlier before the seen incident.). This probably was around the time when the lady saw the scene and called the cops.
This is a situation that calls for the birds and the bees talk. Not Juvenile detention.

This is ridiculous, however I read it happened in Texas and instantly I am not surprised.

I did. Both that post and the one I quoted implied that you had come across actual details of what took place, which is what I was asking you about.

Don't get me wrong, I agree with your original post. I was just mad at that guy for lying to so many people and irritated that so many people took what he said at face-value without bothering to double-check or question what he said.

The whole article reads as the case being handled in a rather over the top manner.

Also, the article is written terribly and I counted 2-3 spelling mistakes, which doesn't really help to report the story.

Pretty silly. Kids experiment like this at that age, they're curious. I highly doubt a 10 year old girl was touching this boys penis with the intent to sexually assault him. Parents have every right to be upset but getting the police involved? Give me a break.

Hell, I didn't figure out girls have vaginas until I was 8 cause me and a neighborhood girl were playing doctor. Luckily we never got caught :p
