Er, I think people (including the escapist writer) didn't understand what he meant by "spam":

When he said "spam" in the Q+A, he was referring to basically anything that a player would rather not see, and when he was quoted on "perfect balance" in this article, he was actually talking about the way they "must create a perfect balance between the value of the information to be delivered and whether or not our consumers will welcome this information," so he was kinda quoted incorrectly here.
I don't think he was in any way referring to the device being hacked. (which seems very unlikely to me) He was just giving a heads up that there will probably be adds, (just like on the 360 dashboard) but they'll do their best to keep it to things the average player would want to see. (probably game-related stuff)
My guess is that as long as the ads are bundled with an optional service such as 3D TV shows people won't mind.

Nintendo president Satoru Iwata recently told investors that the technology has the potential to download unwanted ads as well.
And thus a new market for anti-virus software opens.

The system already costs an arm and a leg, but we're forced to watch ads STILL? really Nintendo....really? what is the game industry coming to?

The adds wouldn't be so bad if they played the "Final Fantasy victory" song when you got them.

My thoughts exactly. It makes me wish for that Gizmondo pricing scheme where you could buy an ad supported version for cheaper. At least it would make sense this time around.

I scream shenanigans! Seriously. The reason why I stopped watching TV (except PBS, and even then I skip over the Corporate ads) and installed ad-blocker+ to my Firefox is because of those &%$@#*& ads. Commercials have ruined TV to the point of banality. A TV network can't have a show that will upset the advertisers. Is it any wonder why all the awesome shows are on cable movie channels?

F!cking commercials are ruining the video game medium. How many patches have been released for games to allow for in-game ads, only to have them removed because the backdoor for in-game ads slowed down the games too much? I'm looking at you, Wipeout HD. There are other examples as well.

It is ridiculous to me that, only after spending (probably) $40 for a 3DS game, or even waking up the system from a sleeping state, I would still have to deal with commercials. What is next? Will I have to watch a ten second ad for Mountain Dew if I pause a game for a few minutes? I don't even drink f!cking soda! Shenanigans.

I was excited about the 3DS, but now I'm not. When is enough money enough?

To protect children, Nintendo barely lets people that own the Wii play its own first-party games together without submitting to a genetic test,
wait, can you or someone PLEASE break this down into something i can understand, what i'm getting from this is either "You can't play a Wii unless you submit to a genetic test" or this is just EXTREME sarcasm...

for the record, yes, i REALLY don't get sarcasm...

So now on top of downloading and installing new firmware, regardless if people want it to or not it, it will also now download spam too, again, regardless if you want it to or not. No good can possibly come of this for 3DS owners.

On the plus side I can see all kinds of fun ways a person with less than pure intentions could screw with a device that just seeks out random wifi signals to download and possibly install god knows what. I imagine with a small amount of clever tinkering the right kind of people could make just about anything (viruses, donkey porn, etc) look like a new firmware update or advertisement for these things to seek out and install. I know I for one can't wait!

Advertisments on my DS? Do not want, as the kids say. I hope there's some way to turn this feature off.

If there is, it would include a monthly fee.

If this or any gaming device is going to give the owner unsolicted advertizing it should be sold a lot fucking cheaper, I'll tell you that.

The Corporate age of gaming sucks.

Can you turn off these automatic downloads? How big are they? I don't know about everyone else, but in Australia, download quotas are pretty strict. I wouldn't want to lose a sizeable portion for updates I don't want...I barely want to sacrifice the downloads for updates I do want.

I've got three games sitting in Steam right now that I don't want to update because my quota can't take much of a hit.

Bad idea...BAD IDEA!

I think I'm going to refrain from overreacting, and simply wait for the product to be released before I decide whether or not Nintendo have committed a terrible sin against gamerkind.

Exactly.

And i have to say that i am extremely shocked that Nintendo even considers the possibillity of Ads on one of their Consoles.

Way too much of what I've heard about the 3DS has been information on how Nintendo are taking control of the device away from it's owner. I really hope it's not indicative of the actual device's functionality, because I was genuinely a little bit intrigued by it. I get annoyed enough when programs on my computer start downloading genuinely useful updates without asking me first; if the 3DS downloads random crap when it literally can't ask for permission (unless it's some sort of opt-in setting), then that's a real dealbreaker for me.

Edit: Actually, does anyone know if Nintendo have explained whether we can turn this stuff on or off yet? I realised that I might have just missed the announcement and am ranting against the 3DS for no reason.

This scheme is for leeching unsecured wifi bandwidth. That's what 'hotspots' are - areas with multiple unsecured wireless networks that anyone in the area can just leech if they've got wifi equipped gear.

Moral of story - secure your networks
