I'm pretty sure most everyone can agree that this was simply a raw deal (I wasn't even a victim of it, since I got the game on the 360)

I do hope they win, not only because justified class-action lawsuits are so rare in this industry, but also to send a message to all publishers: this kind of crap should not, and cannot be tolerated. If you decide to pull something from your product, it must be immediately and noticeably advertised to your customers.

100% this. I'd hate to see the chaos that would ensue from EA winning this case. The customers have been wronged and EA winning this case would open the flood gates for companies to walk all over us even worse.

It depends on how you view this as to whether you'd consider it a small issue. Saying that people will get a game with a brand new copy of Battlefield 3, then NOT giving it to the costumers is a horrible business move.
Imagine being an excited costumer who, on Battlefield 3 release day, doesn't get their copy of the other battlefield. How upset would you be?
Getting that extra game was an incentive for people to buy the game new, but now that they didn't get it, they may not even feel like there's a reason to buy the game new in the future.

Beside that, this can be considered false advertisement, which is illegal. If you promise your consumers something that they don't get, then you're in the line of fire.
I'm glad you're not taking the side of EA, because they clearly are in the wrong.

You know that doesnt explain why people are sueing EA. From that article it was not EA who announced that they were going to give away free copies of battlefield 1943 but actually Sony who said it. That pretty much means that if EA feels like fighting it then this lawsuit will collapse extremely fast. Going by that article they do not have any grounds to sue EA.

It didn't contradict the statement until after the game came out. Sony can only promise what they directly made a deal on or what EA tells them to, they cannot legally make promises for games on their system, only what the developer tells them to say.

The thing is though EA should not be held resposible for something that Sony has said. They probably origionally had an agreement to include the game but for some reason or another it fell through or they didnt have time to include it.


I am actually really surprised that they are sueing in the first place since this sort of thing happens all the time with lots of different companies.
Can I get an example of this happening? I'm not familiar with any other instances. And its clearly illegal. If you sell a house and it includes a free parking space, and then you don't get the parking space, you've been cheated. Same thing here. Just because its smaller scale doesn't mean its okay.

And like everyone else has said, glad to see a legitimate lawsuit, hope EA will pay for their PR department(or Sony's, or whoever) being incredibly dumb, and most of all don't want to see shit like this pulled again.

Also, they did mention on forehand that the "promised" deal wasn't going to happen.

Similiar type situiation with Saints Row the third, PS3 gamers were promised an exclusive mode (supposedly Wh*re mode - not confirmed), when PS3 gamers didn't get the exclusive mode what did THQ do? Give you Saints Row 2, missing 1 mode - free game. Learn something EA, not this 1 week early DLC rubbish.

You can't spell chEated without EA.

i thought this was frivolous before i read it
well if EA made a promise of a free game and then broke the promise(essentially they pulled a dick move). then it's called false advertising and there is an actual reason for this law suit.

Oh God, that statement gave me a Vietnam flashback. The year was 2008. I was discussing a television advert with some friends. I was discussing this feature that this new thing (it's been a long time, I forget the specifics) was advertised to have. The basic gist of their argument was "oh, there's no way they'll put that in, they're just doing it to trick people into buying it." I replied, "no... that's not how it works. These were the same people that believed swallowing chewing gum damaged your stomach lining because the non-digesting mass made the acid level in your stomach rise and that only the bottom few inches of stomach were fully immune to the effects of the acid. They didn't seem to understand how gravity works.

I thought my Father's stance against buying anything they published was a little harsh, but it seems seriously justified lately.

They make me not ever want to buy anything they ever published.

You know, I'll bet everyone here that they only ever offered this to compete with MW3's Steam offer where if you preorder, you git the original MW.

It's like EA doesn't even care anymore, they know people will buy their crap.

Hopefully this will act as a wake up call for them

EA needs to be put down a peg. The EULA crap, the Origin crap, and now this? EA, get your head out of your ass, and stop humping wallets long enough to realize you can't shill people forever. I especially think the EULA stuff is crap, because as far as I can tell it basically says this:

You give us your money for this service. We aren't required to even provide the service after being paid, if there are problems with the service your SOL we'll get to it when we feel like it. And don't dare complain about the quality of the service we're supposed to be providing, or you will suffer more under our heel.

I know that's probably hyperbole, but I've never been able to read the whole damn EULA before in one sitting and decipher that legal jargon of it's.

I just hope they don't screw with Bioware too much if they do lose. Stay safe Bioware!
