I wasn't talking about my own views on what is and isn't protected by freedom of speech, I was talking about how many of the European legal systems work, like you would probably know had you spent more then 30 seconds reading what I wrote.
Don?t turn this into a flame war by insulting my ability to read. I do apologise if my prior post appeared aggressive, I was writing it rather hastily. I read your post fully, and understood what you meant. I was under the impression that you were making the example of these laws to further your point of being 'sick' of the incorrect expression of freedom of speech.
I haven?t got time to research the topic fully, but I did upon a very quick google find this on Wikipedia:
http://en.wikipedia.org/wiki/Freedom_of_speech_by_country#European_Convention_on_Human_Rights
I have not read the entire article, as I haven?t the time this morning, but I do find it interesting that under the heading of European Convention on Human Rights we have a short quoted paragraph on the restrictions. These include aspects, per country, that are prescribed by a court of law in the interest of
'national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or the rights of others'.
I would have to argue that a child or otherwise, creating a Swastika emblem on his profile in Black Ops may constitute, very loosely, to 'disorder' or an attack on 'morals'. But ultimately, it is such a minor gesture that I would suggest censorship of such in the public space to be absurd. Of course, we are not talking about the public space, which frames the discussion very differently. I still stand, despite factual information on laws that I have yet to see, that censorship on such a minor level is in fact a hindrance of freedom of speech. Next, we will need to censor novels and movies for their larger and far more evident ideological leanings if a couple of images are so hurtful to the 'rights of others'. If censorship begins somewhere so simple, then where does it end?
