People feel pity for her? You do so now because she got busted but hell, if I knew someone is doing something illegal like this, making hundreds of thousands (or how much it is) dollars with Blizzard game, I would want exactly this happening to said person.

Also doesn't sound like she payed a lot attention towards anonymity etc. x.x

so? I still don't see your point.

giving up the profits is fair however in this case, a 85m fine is unnecessary and damn right ridiculous even so, when the information is based on unsubstantial evidence, everything gets blown out of proportion.

by the way, don't edit a quote to fit your agenda. it's rude and childish.

Her best bet would be to not appeal and file Bankruptcy. Let the Bankruptcy Court fight it out with Blizzard.
Oh I'm sure she filed a second after the decision.

This whole lawsuit seems aggressively unnecessary. One would think they could just issue a C&D and call it a day, instead of ruining someone's entire financial future over a, to be frank, irrelevant issue.
Blizzard worked very hard for several years to develop that product before it came out and have worked very hard to keep it running, and keep new content coming out. No one deserves make make money of of that product other than Blizzard and if your try then in my opinion you deserve to get royally ass fucked by the court. Do not steal other peoples hard work and make money off of it yourself. This is hardly an irrelevant issue. I do not know how much money she made but it could be in the millions or tens of millions depending on how many players she had on her server and how much they spent on micro-transactions. And no one has the right to make money off that product other than the people who created it.

Jesus christ why are people so bad at crime.

If I had less ethics and was more motivated I would totally do this. 1. incorporate anonymously (in nevada) 2. create accounts for merchant transactions on behalf of your corporation 3. buy your hosting on behalf of your corporation 4. pay yourself a salary equal to your revenue - operating costs

It is almost impossible for blizzard to prevail in a suit against you personally when you are acting on behalf of your corporation. And if they sue your corporation just declare bankruptcy, dissolve the corporation, re-incorporate under a new name and carry on.
If Blizzard couldn't slam you with the financial pounding they gave this girl then they would simply hit you with fraud charges and let you rot in prison for ten years. The reason they did this was because the headline "Dumb ***** gets charged $88 million dollars for stealing from a company" is a lot more likely to give people pause than "Dumbass gets sent to prison for committing corporate fraud against Blizzard." They don't actually expect to get this money from the girl they just want people to stop making private servers and stealing their hard work and making money off it.

And why are people blaming Kotick for this? He is an asshole sure but he doesn't do everything in that fucking company. There is more than one corporate position at Activision Blizzard and unless they were all filled with stoners Blizzard would have done this no matter who was in the CEO position at their sister company.

Why don't you read the first page and notice that the part that says I quoted from you you DID NOT say. I had you and like 3 other people quoted but THAT part that I did quote was what I was actually responding to.

Don't jump to conclusions because THAT is childish.

Also to go back on to the 85 million dollar fine. If they fined her something like 250k or something like that along with everything else and she was able to pay it back easily she would probably think that she could get away with it again. The 85 million dollar fine is to:

A) Send a message to all Private server owners
B) The Private server infinged upon their copyright of the materials and if I remember correctly that is a SMALL amount for copyright infringement.

Personally I think that she is VERY VERY lucky she was not hit with a much larger fine.

Now this is harsh. Sure, private servers are illegal, but taking in consideration that WoW has 11.5 million people playing it on the official servers, I wonder why they are starting to attack private servers.
thats like a thief saying "everyone else payed for *insert product here* so its okay for me to steal it because it doesnt equate to much in the grand scheme of things". it doesnt matter how many people do things the legit way. its still illegal. and while 88 mil might be overkill, blizzard still has the right to sue and recuop what they have lost as a result of this persons actions

Normally I would say this was dick move and far to harsh, but she did make 3 million dollars off of blizzards game. She didn't make the game and has no right to profit form it.

1. Its a default judgment, meaning the defendant didn't show up. The judge didn't even look at the facts of the case.

2. Private servers for MMORPGs require a working copy of the game to play. Everyone's already paid blizzard their money.

3. Donator items are well known on private servers and I'm sure many other people are getting more than server costs on donating and paying for cool items.

The market just found a MMORPG model that Blizzard didn't want to compete with.

88million is too much for a single person to EVER pay. she was dirt stupid to charge micro transactions, but she still doesnt deserve this much.. chances are she will appeal and it will drop VERY significantly, and blizzard plans on this... they are not out to ruin her life exactly, they are out to make an example of her, and even if she doesnt end up paying 88 million, the press has already made this a big deal... same thing happened with nintendo and an r4 salesman

i'm amazed they got away with this: everyone has the right to a good standard of life: I.e. food, shelter, water, communications, freedom and (in most countries) the right to live up to a standard higher than just those basics. Plunging this woman into that kind of debt is going to seriously harm her ability to have those basic rights (as provided by international laws). Also, Blizzard are selling a product: by it's very definition if someone buys a product they have the right to use it how they will: a company cannot sell a person a chopping board and tell them they can only use it with peppers and nothing else. I don't see how Blizzard are in the right at all with this- just an opinion

Humm I don't know how I feel about this one. I hate Pirates and Blizzard about the same, but this is a little excessive, on the other side she did steal their product and let people play it for free.

This just makes me hate Blizzard even more, I know Activision is the worst Publisher, but Blizzard is definitely becoming my least favourite game developer. It seems they are always just out for profit, with all their microtransactions and splitting of games to make more money. And this has nothing to do with ruining another persons finincial life,Blizzard literally will drain as much money as they can out of things(Maybe even exposure to Activision will turn people greedy).

It always makes me sad when people praise Blizzard for how much money they make and translate that into them being good developers, like tripping over profits to make a game is what the industry needs. It's sad because the guys with the big bucks shape the video-game industry and people's expectations and quite frankly more mmo's,microtransactions, subscription fees and unnesecary splitting of games isn't something I look forward to, especially seeing as even if Blizzard splits Diablo 3 into 4 games, gives it a subscription fee and makes you able to buy items to make the game easier, it will sell like hot cakes and make 3 million from micro transactions in the first day.

The thing is, it's a product they're selling- once they have sold it it is no longer theirs- it is the property of the person who bought it. Would you be happy if someone sold you a house and then told you you were only allowed to use "x brand" furnature in it to make it hospitable? and that you would be prosecuted if you bought the cheaper "y brand"

They could have one $500MM it doesn't matter. They aren't going to see but a small fraction. The money she made she will need to turn over whats left. File Bankruptcy and start over. But it is a lesson learned.
