Family matters are generally not criminal matters.
Both the police and the courts have better things to do than sort out various conflicts which might linguistically fall under a fair few penal code articles, but which parliament never really intended for the law to regulate. Only physical violence or quite significant economic crimes are generally dealt with by law enforcement when internal to a family unit.
The drug charges will stick though. But selling out your own brother isn't cool[footnote]Considering that legislation about bearing witness in criminal trial generally
recognizes this as a legitimate view, by not forcing people to testify against close relatives, I think it's safe to say that such loyalty to the petty crimes of one's family is well understood - perhaps even encouraged - by the law itself.[/footnote], he needs help, not a criminal record.

Turn on the Xbox 360's parental controls. Set them to run on every game rated above PG. Essentialy, making everything unplayable on it, unless you know the code... which only you will know.
Definitely the smarter way to deal with anyone within the family "borrowing" it.
