Do you still have to be 17 to pre-order and buy M games. I thought that was lifted due to something in california and it reaching the supreme court but I'm not sure. Oh educated Escapist community please help!
Also do you agree in the age ban?

I'm pretty sure the ban failed so you should be good. As for agreeing, I starting playing Halo 1 at 9 and so far I'm not fucked up.

I think it depends there are deffinalty kids out there who think they are mature enough when they really arnt. I was allowed to play m games since as long as I remember but my parents always payed attention to the games I bought and they never really cared about violence since they new I was more of a outcast than a follower I wasnt the type to be influenced.

Yes you have to be 17 to pre-order games. The game industry is self regulated meaning retailers aren't supposed to sell M rated games to children that are under that age of 17. That is just how it goes. The law in California had nothing to do with the ESRB and actually wanted to overrule it and make it a crime to sell games to people under the age of 18.

The law was unconstitutional because it broke First Admendment laws, this just simply means the government can't control the distribution of video games in that manner. It doesn't change the way the ESRB operates or the self regulation inside the video industry

Is it illegal to sell or rent M (Mature) or AO (Adults Only) rated games to children under 17 and 18 years of age respectively?

ESRB supports retailers? voluntary policies restricting the sale or rental of M (Mature) and AO (Adults Only) computer and video games in the United States and Canada to customers 17 and 18 years of age or older respectively unless permission from a parent has been obtained. Through efforts such as the ESRB Retail Council (ERC) and a strong commitment on the part of major video game retailers, stores have vastly improved the rate at which they comply with these store policies, as measured by both the ERC mystery shopper audits as well as those conducted by the FTC. More information on federal, state and local regulations in the U.S. is available through the websites of the Entertainment Merchants Association (EMA) and Entertainment Software Association (ESA). In Canada, you may contact the Entertainment Software Association of Canada (ESA Canada) or the Retail Council of Canada (RCC).

So you may find a retailer that will sell you a game, you may not. It is up to them.

EDIT: No I did not agree with the new regulation proposal. It was basically saying to parents that they don't know how to raise their children properly. The government needs to figure out something else to attack instead of video games. Video games don't make people crazy, genetics and poor upbringings do. Try fixing the latter but increasing social programming and mental health programs.

Hell No. My first M game which was Tom Clancy's Raven Shield Rainbow 6, was played when I was 7. Every game I own is M with the exception of Scott Pilgrim; and I turned 17 just a few days ago. Just like how my First R rated movie was CHUCKIE and I was 3 when I watched it.

To me, the rating system is a way to avoid angry puplicity and lawsuits. Its
a very grey area, but I feel its more of a suggestion than a requirement. If you are honest with yourself and think you can handle it without getting Ideas to jack a car and rob a bank, go for it.

I think so. I'm 17 and they always ask me for my driver's license.

Yeah ya do :/ even though the supreme court ruled it unconstitutional so its kinda bullshit. My brother is going to college soon so for a year I'm going to have to say "hey mom can you come with me to buy a game?" it is incredibly annoying

Gamestops a huge dick about that. Even if you have someone 18 there they have to be your parent/guardian. I know one of the employees there who loves me and my brother but I'd still have to get her working to accept a friend.
