1. This mostly makes me think of Final Fantasy 7 where you just grab gold out of a kids drawer next to his bed, I remember playing that part and thinking "T-that's theft, aren't I meant to be the good guy?"

2/3. In the Elder Scrolls oblivion you can steal just about anything but none of these items can be sold like regular items, no one in the entire game other than special traders will buy these from you. As an example to it being ludicrous if I were to steal an apple from a house on one side of the map then go to the other side no one would buy it due to it being hot goods.
Kinda wack if you ask me.

In terms of option 2, try looking at MMOTPS APB: Reloaded.

The criminal faction has a (initially) non-PvP system of Ramraiding, where you drive a car into the shop front and steal all the crap that comes out. You then have to take this to a dealer etc. It becomes a PvP scenario if an Enforcer witnesses you.
