And being a wise ass while he was talking to me and asking for an ID.

Charged with disorderly conduct.
I co-operated completely during the arrest. Gave him my information (albeit in a smart ass way).

I can beat this in court right?

Probably not, insulting police is actually an offense, as stupid as it sounds...

And disorderly conduct is such a large offense it covers anything and everything... it's a minor offense though, you won't go to jail or some crap.

Why be a smartass when dealing with a officer? That's disrespectful and just not a good move.

You could probably fight it in court if you want to spend all of the money for legal fees and what-not.

Unlikely. Cops have a tremendous amount of power, regardless of where you go - even if the cop was being a dick to you, they don't take kindly to smartass-ery. It's a minor offense, sure, but I don't see you beating it.

If it's your word against his probably not.
If it's your word against his and he's a "clean" cop, no chance.
If it's your word against his and his partners, no chance.

you're best off admitting it and apologizing.

Why the attitude? Drunk?

Why is it illegal to begin with?

I have the first/fourteenth amendment behind me completely.
You're more than welcome to try, but it's not going to work (it's not like you're the first one ever to try...)

Only way you'd win is if the cop dosen't show in court.
As far as to why it's illegal, i'm no expert but the police is supposed to be upholding order, what good would that be if we could treat them like shit ?

Anyways, i don't wanna argue about this, try it if you want, but your chances are pretty slim.

Well that was an incredibly stupid thing for you to do. NEVER back talk to a cop, it's just not a good idea.

I have a copy of the police report.
I asked for it. They're bound to that.

If I was drunk I would be guilty, good thing I wasn't.. They asked me if I was drunk.
I said, "Nah. I'm just a dick."

Seeing as how you created this situation by saying something that was clearly not needed to be said I say just go to court, say you are sorry about it, and take the punishment they give you.

Cops do have cameras on their cars so even if you said he was being mean to you they can review the tape.

You know, it's funny as a "coloured" individual, doing anything but COMPLETELY cooperating and kissing ass with a cop results in getting fined or arrested.

Oh to even have the ability to talk back to an officer without fear of retribution.

The cameras point forward. I was more behind the car the entire time.
He was a erk to me but thats not illegal.
I don't care. He shouldn't either.

I just say take the punishment. Much better than having to pay the fees for all the legal stuff. Plus, this one incident is not really that important. Not really life changing or anything.

It's considered disorderly conduct if you're disruptive and someone can take offense to it (ie drunk in public or disturbing the peace). And calling a cop an asshole is both fucking stupid and falls well within the parameters disorderly conduct. True you have the right to free speech, but there's no guarantee that there's not going to be any consequences. Because no one is really free.
