I got arrested for calling a cop an a-hole.

Being impolite is not illegal.
What is unethical is not always illegal.

God how do people not get this?

Those little seat belt check posts are unconstitutional too and red light cameras, and phone tapping, and Guantanamo, and many other things as well.
Indeed. I'm often surprised at people who claim to love the US openly break the very ideas it was founded on.

If only there was some kind of system whose job it was to look at laws to be passed and decide if they are Constitutional.

Moreover, if only there were some kind of legal system that were set up to deal with breaches of the Constitution.

Sadly, there aren't.
I think the ACLU comes close.
If that were true they wouldn't still be able to hold people in Gitmo, tap your phone, arbitrarily stop protests and enforce the (Anti-)Patriot Act.
Touche. Never said it was perfect but its better than nothing. However, I'm pretty sure you described their mission statement.

I agree. I dont think any of the other parties (maybe not lib dems, but they dont really count as no one takes em seriously), would have done anything different tho.

Not that what you did was all that wise, but fuck that. Cops that arrest people for trivial things like that are ones who feel like they're some big shot who should be respected because of their uniform. I have little respect for cops, especially considering how many of them either abuse their power, are corrupt, or both.

Charged with disorderly conduct.
I co-operated completely during the arrest. Gave him my information (albeit in a smart ass way).

I can beat this in court right?
If you want an overview of the legal situation; read this:

http://en.wikipedia.org/wiki/Contempt_of_cop

http://en.wikipedia.org/wiki/Defamation

It sums the overall perspective well up.

A few general notes:

- Insulting a cop or anyone is a crime and is NOT covered by freedom of speech. Many people are guessing that the constitution allows to say what you want to who you ever choose and that is certainly not the case if you interfere with the personal rights of others.

- The question is not IF you are allowed to say to the cop whatever you want BUT if you want to plead non guilty then you have to argue that the insult was meant to be a joke and to be taken lightly and laughed at.

- The easiest way is always to plead guilty, come up with a tearjerking story or two and show some regret. That is easy and you will come out with a much smaller penalty.

I hope that these words of advise can help you to reassess your current situation in this affair. Good luck!

I hate cops. I really do. I don't care if they are risking their lives or whatever, they don't have to be assholes. I was walking out the back of a movie theater late at night with my friend. A cop was patrolling. He pulled over and accused us of trying to break into cars. I told him we were just getting out of a movie. He didn't believe me. I raged. He asked me for my information. I gave him my name, my age and where I go to school. He tried getting my parent's cell numbers and my house phone. I told him we had neither. He was ignorant to the highest degree. OH and there were minors smoking IN FRONT of the theater. He didn't do anything about it. They were all at least under 14. Messed. Up. Stuff.

But play it cool in court. I mean it's court.

Yep. And also because a vast majority of people are stupid in general.

Why should he!?
Why should he?! Because that officer spent a whole 12 weeks learning to become a better person than him, (as well as learning to make funny sounds and get into shenanigans with Steve Guttenberg). That's why!

You're living in some idealized universe where everything the law enforcement does is legal and is in the best interest of the general population. Police (not all of them of course) do things like this all the time and they get away with it, so the best thing to do is to just be polite and cooperate. It sucks and it's not fair, but it's the truth.

No. Defamation must be published and does not ban opinion. And Contempt of an officer applies to a direct threat, not being an ass.

Not all cops are like that. Most people become cops because they actually want to help make a difference in the world by stopping criminals.

o___o
Shit
"libelous publications and even verbal challenges to police officers have come to enjoy some constitutional protection. Chaplinsky remains the last case in which the Court explicitly upheld a conviction only for ?fighting words? directed at public officials."

That's a fallacy, what people have convinced you. Technically the Conservatives believe in a smaller state and certainly smaller state spending. Without the cash the Civil service would not have been able to pursue their surveillance fantasies.

Trust me, Labour are the worst government in a LONG time. The only reason things have eased up of late is because they're short on cash and realise that their policies aren't very popular for an upcomming election.

It all comes down from Tony Blair who has a disdain for the legal system. Just look at what they've created:

-Indefinite detention without trial.
-Inquiries that are no longer independent.
-War in Afghanistan with no purpose.
-War in Iraq through clear lies.
-The murder of Dr. David Kelly.
-Terror law used for general policing.
-The first trial without a Jury in 800 years of English history.
-Effective banning of public photography.
-Direct influence on policing from private bodies.
-Monitoring of all web browsing and phone usage.
-Loss of privacy.
-Increased monitoring by massive increase in CCTV.
-Massive increases in the public sector.
-Huge Council Tax rises well above inflation.
-Terror laws used to watch families who may be lying to get their kids into certain schools.
-Depreciation of the Higher Education system.
-Massive NHS spend increases with significant Hospital closures.
-A benefits system that endlessly supports those who can't be bothered to work.
-Unsustainable Housing bubble propped up by stimulus measures.
-Failure to stop July 7th terror attacks despite the new laws.
-Murder of Jean Charles De Menezes.
-The BIGGEST economic collapse in decades through de-regulating the banking sector.

And just in case you believe the hype - Saving the banks.
We're all in debt to the tune of £800,000,000,000 to cover the gambling of the banks. They have destroyed capitalism and given massive bonuses to the banks using debt that WE have to pay back.

He was in his car driving by when I called him an asshole. I kept walking and then heard a car door slam behind me.

I turned around. He had came after me.

I'm afraid the experience from most would tend to disagree with you. If they wanted to stop criminals then they would walk into the NSA building and arrest them all for illegal wiretapping.

Cops become cops because they can't do anything else. They have power trips and want to control the lives of others. There's nothing to stop police having criminal records or kick them out for commiting a crime.

They're ALL scum. Also, tell me this, how many police officers would arrest their partner if they saw them strike someone without cause? Enforce the law my arse.

It's not really stupidity; it's more that a lot of people have underdeveloped ethical systems that rely on authority figures to implement some kind of moral code. They don't understand the concept of choosing right over wrong for its own sake. Rather, they avoid wrongdoing because of the negative consequences associated. Of course, that's one of the reasons we live in a republic and not a democracy.
