They aren't suing over the word. They are suing over the word in the context of video games. Imagine I wanted to make up a fast food chain called "Kent Fried Chicken" Fried Chicken is by far a more common word than "Scrolls", which outside of video games no one but scientists use.

A lot of people missunderstand that copyright lawsuit is not about words, but about words in a specific marketing context.

I want to make it clear, I have been lusting for Skyrim since it was announced. All press I have seen looks magnificent. Everything I have heard sounds incredible. It looks like another brilliant Bethesda game that I will subsequently lose a massive portion of my life and time to.

And I will not be purchasing it.

I will not support a company that attempts to use lawsuits as a means of flagrant bullying and outright douchbaggery in order to crush perceived competition.

If Bethesda goes through with this utter horseshit of a frivolous lawsuit, I will no longer support Bethesda.

Even though this means I will never play Skyrim, I will no longer support Bethesda in any way.
Good for you, but I'm still getting the game, because the legal department is not the same as the development department, who are the reason I'm buying the game. Anyways it physically can't just be about the name, as anything so petty as a lawsuit over a one word name would get immediately dismissed, if not laughed out of court. There legally has to be more for this suit to hold up.

Character creation, primarily. If they're sticking to the 'lore' I keep hearing about and dreading, then all of the races from Oblivion will be cast aside so that you can be some random Dragonborn which is just a human with a spiffy name apparently.

EDIT: Waitwot? There was someone above me mentioning it, I just went with the flow. Apologies on my hand then.

I did it for New Vegas but ended up buying it anyways.

that makes absolutely no sense. youre saying that because it is a video game situation, that it is okay for bethesda to sue over such a vague word. its not. its like saying Activision should be allowed to sue any developer in the future that uses the word "Duty"

He just explained to you exactly what a Trademark pertains to. If some company released a soft drink called Scrolls, Bethseda couldn't sue them as the context is completely different.

But yes, Bethseda sueing over all of this puts a very negative image on the company as a whole, and due to all of this I've completely lost interest in Skyrim. I'll go play something more interesting and fun, like one of the Disgaea games.
