You bought the disc which contained the game. If you did not take care of it then that is your problem.
If I buy new headphones then snap them does that mean I can take em back for brand new ones? I buy new shoes then get drunk and wade through a swamp, new car and drive it into a tree. Do I get new ones of these due to my carelessness?
If you have broken the game or the device that plays the game then you have no moral right to download it.
The law is the law. Do not judge other pirates when this proves you are okay with it for your own reasons.
You don't buy a license to own shoes or headphones though, it could be said that you do buy a license to use the software that comes on disks. The vast wondrous bounty that is The Internet has pretty much every piece of software out there. You can't really tell me straight that downloading a ROM of Sparkster: Rocket Knight Adventures is illegal when I own a fully functional cartridge and console, but ripping such a thing from the cartridge itself and putting it on my computer should be legal. That's completely illogical. What does it matter the source? I paid for the software.

Steam is further evidence that we're paying more for the license of the game's software than an actual copy of the game, now that I think about it.

Surely it's the same logic behind having a backup of your CD files. Physical things do not suffer under the same laws as computer data, and so they shouldn't. They're two very different things.

no. i've downloaded a few games but most of them are SNES/Mega Drive games i had when i was growing up and play for mostly nostalgia.

I have no problem with it, as long as you bought a copy before and accidentally lost/damaged it. But try be more careful with your stuff.

No, why the f*** would it be wrong? you bought a game, the company got it's money, everyones happy (assumign the game is good) now the game breaks, but you've already payed for it, so it's not like the company is loosing a costumer, seeing how you could've just backed it up before it broke.

I actually even think it's somewhat legal as well, since you're already allowed to make a backup-copy of your game/movie/cd anyways. And if the anti-piracy-group comes knocking, and sys you've downloaded awesome-game 2 you just tell em, it's a backup, i've got the original right here, so i'm a lawfull costummer, go harras someone else, or i'll have you arrested for trespassing.
