I was amazed by the 99% conviction rate. I'd like to see the surrounding stats, like what percentage of cases go from investigation to trial. Is the burden of proof less rigourous? Can anyone with experience of the Japanese legal system help out with this?

I wonder how many riots they get when the inmates have absolutely nothing to lose?

Eastern State Penitentary was shut down for this very reason. Complete isolation tends to drive gregarious human beings completely insane. Like eating your own flesh, murderous urges etc. Its why american prisons are more social. Technially it maybe against the UN Human Rights council and Geneva Convention. But I can't be certian. Its unethical tohugh.

Having formerly (and sometimes still) worked in corrections I can say that's outragously overboard. How do you expect someone to not cause you any problems in that situation? What leverage do you have against them? Isolation is used as a punishment of those who break the rules within the faciliity. Not just because.

By doing this you put your officers in danger or what if they are granted release? Now what do they do? Go to an asylum.

There is a reason I can sit in a mod with 60 violent individuals and not get the shit kicked out of me (like I am RIGHT NOW) it's cause I talk to them and treat them like people. Even though they don't deserve it.

I've seen enough to know that I've got hard time feeling even remotely sorry for a murderer. Personally, I too think it takes too long, but I also think it's too merciful and sterile and private to be a proper deterrent against violent crime. Think a killer is worried about a needle, a sharp quick jerk of the neck, or a quick and relatively painless bullet to the brain? If people were still drawn and quartered then they might have something to be afraid of when they consider putting a bullet into some poor 7-11 cashier's chest over $30 and a box of lottery tickets.

In the good old times, prisoners where used to test the cut of a new made katana.
It'd be over fast, not after 40 years of rotting in a cage.

But then again; if the scentence would be executed (lil pun) immediately, would the death penalty be worse or BETTER than life in prison? :eek:

Well that sort of matches my view on what you should do to mass murders etc, punish them for what they did don't just kill them.

I can`t fucking understand the system..what the hell was wrong with shooting the death row prisoner the same day you convict him/her and make him/her pay 1$ for the bullet?????????????

That's basically what China does, they shoot the fucker in the head, then send the bullet casing, along with a bill for the bullet, to their family. It's a good system.

I call it punishment and relief. Making them go through that, then putting them at rest. Doesn't seem too bad to me.

Although to be honest they shouldn't be kept around for decades, atleast execute them sooner. Saves money and time for the tax payer/prison system/government
What if they're innocent? They usually wait 10-20 years or so before execution, in case new evidence appears, to make sure they're the right person.

Yes, it's cruel, for the same reasons why it is cruel to inflict physical pain and emotional stress on animals you intend to slaughter.

If the inmate is set to die anyway, why not keep them in the general population of the prison during the time it takes for court appeals to have the sentence overturned? What's the point of locking someone up for 40 years and deprive them of all human contact if they are going to die anyway?

It's not like they are expected to "learn from their mistakes" now is it? : )

Even the ones who are innocent of the accusations against them but they still sit on death row?

No legal system is perfect you know, and a society with a legal system that advocates the death penalty is a society of murderers.

Sure, the police system might not investigate cases of executed felons and actively turn deaf ears and blind eyes towards the possibility of that society having executed innocent people. But innocent people have most certainly been executed for crimes they didn't commit.

That's the problem with the death sentence. It's not like you can just let the accused out from the cell and tell them you're sorry for the mistake. Once you're dead, you're dead, and the blood of the innocent will stain EVERY CITIZEN's hands in that society forever.

Is it worth the state killing of innocent people only to be able to get the real criminals as well? Does the ends justify the means and the consequences of those means?

Life imprisonment is one thing. At least then the court offers the benefit of a doubt and acknowledge the fact that the legal system isn't and can't be perfect, but it's doing the best it can, and that you offer the chance to set an innocent man free if proof arise afterwards that a mistake has been made.

Killing them can only mean one thing, and that is naive behaviour. It means that the court believes that it is flawless...

Personally I just think people who get on death row should get shot right away.

Why? Well I just don't see a point in keeping them alive and have them waste our money.

As for this. I honestly don't care. They knew fully well what they did and they deserve this in some way.

There will always be evil people but if you keep letting them out it isn't gonna make things better. Most criminals too re do their crime and most of the time it's on the very same day they are released.

I don't think these conditions are "cruel." People on death row are usually there because they caused others to suffer; it is only just that they suffer as well. Death is the easy way out and no matter what your beliefs, there really isn't any reason to worry about death. 20 years of isolation? Now that is punishment.
