M$ infringed Motorola's patent, thus IP. So, the consumers, whose rights are to be "protected" by the IP - as per your logic - are Motorola's consumers, not Microsoft's ... Therefore, the judge's reasoning of Motorola's IP being more important than Microsoft's consumers is perfectly valid.
Because Motorola was TOTALLY going to make a game console, right?

If anyone followed patent law, we wouldn't have the awesome smartphones we have now. So, yeah, I'd say that MS is actually correct here, this decision would hurt consumers. Patent law is the real problem here.

Quite matter-of-factly IP law is a huge screw-up causing more harm than good. That changes nothing to the fact that it is still in place. It's the same issue as with Virgin: It's one thing to smash someone who acts according to the law in place. It's another to take down those responsible for the law to begin with.

Criticize the government that maintains the law, not the judge deciding through it. Except for a federal court capable of actually declaring the law invalid, there is no legitimate way of solving this issue. The court did nothing wrong, it all makes sense according to law. Common sense tells otherwise, yes, but that's simply nothing a common court can legitimately act upon.

If you genuinely think Microsoft are the only company who have stolen other peoples ideas or pulled sketchy bullshit to gain an edge in business then you are incredibly naive.

Hell, Thomas Edison stole the majority of his ideas and he's still celebrated as one of the most prolific inventors of all time. Nintendo, they're squeaky clean, right? Oh snap.

Any company as big as Microsoft, I can guarantee they didn't get to where they are playing by the rules, but you just keep hating on Microsoft because they're the easy target, kiddo, instead of actually reading up on things and maybe expanding your knowledge.

Easy Target? Hey, you can not blame them for being hated. Taking something that a group of people believed should be free and shared is something your okay with, then hey that is fine with me. What ever helps you sleep at night.
But as I and quite a good number believe other wise. So M$ will always be used to show our discussed with them.

Anyways you are entitled to your opinion, it just does not mean everyone cares to hear a child screaming and cussing in to they're microphone because they have issues with life/call of duty/360.

I've been on the fence this whole console generation, i'm personally waiting for the 720, if it's top notch ( 120 hz, no camera reliant bull-crap and doesn't have insane pricing scams )
i will buy one immediately
i prefer play-stations as a style statement, but they have little else going for them
well, a bluray drive would be nice i guess 'shrug'
if not, ill stick with my pc and just keep incrementally upgrading it
as that's just a better pricing structure, and advancement program for me
plus i feel involved in my hobby, and i like that.

You are confusing patients with copyright, a common mistake and understandable considering the bull crap the media and large corps are coming out with.

I am not saying there is anything wrong with putting copyright on a item of software or a game that fine. But you should not be able to patient an idea

For example say the creators of ultima online had a patient for a persistent on-line world, you have just removed any chance of anyone else making an MMO no Warcraft no TOR no anything. Or say that studios patients where punched by a patient trolling corp . They could extort masses of money from any studio trying to make that style of game.


This is something that many people are confused about nowadays. They lump patient law and copyright into the same F***** up mess and it causes all sorts of confusion.

And dont even get me started on "downloading movies/music/games is theft" its bloody well not its copyright infringement its totally different.

I used to download quite allot of software music ect. I don't do this any more, and if i do i treat as a free trial if whatever i have is good i will buy it.

Or TV shows that have been off air for years and years I am not paying the extortionate price to buy 8 seasons of a TV show made 10 years ago when only the publisher and not the arts creator will get anything from it.


Simple no patients on ANY software or firmware period.
Copyright should expire more quickly (10 years).
The rights to a franchise should go back to the original creator in 5 years.
