I, um...Hrm.

It does say that she could pay more and stay there. He's not out-and-out barring the woman from getting the dog. That will probably be his legal loophole.
I doubt it. He's being accused of discrimination. Charging more because she has a debilitating disease and a medical pet isn't a way to wiggle out of the discrimination accusation. It's more ammunition against him if anything.

Either way, it's a dick move. But so is the lady suing. It's not like the guy is throwing her out...She has the option to pay the fee and continue with their collective lives.
If you go back and read what the OP posted, it's not her suing him. We also have no way of knowing if they can actually afford to pay more. I'd imagine taking care of their daughter probably doesn't come cheap, so if it isn't all covered by medical insurance they may not have any other options.

THEY SIGNED A FUCKING LEASE SAYING NO PETS ALLOWED! END 'O STORY.

And the landlord broke the law.
[small]Enforce the terms on your lease.[/small]
"Your a horrible person and your breaking the law you fucking monster"

If it says no fucking pets, move somewhere else. If I was the landlord I would have evicted both of them by this point.
Illegal clauses in a contract cannot be enforced.

Also, again: service animals are not pets.
