I doubt it. He's being accused of discrimination. Charging more because she has a debilitating disease and a medical pet isn't a way to wiggle out of the discrimination accusation. It's more ammunition against him if anything.
Either way, it's a dick move. But so is the lady suing. It's not like the guy is throwing her out...She has the option to pay the fee and continue with their collective lives.
If you go back and read what the OP posted, it's not her suing him. We also have no way of knowing if they can actually afford to pay more. I'd imagine taking care of their daughter probably doesn't come cheap, so if it isn't all covered by medical insurance they may not have any other options.
