Most people are probably aware of the lawsuit [http://www.escapistmagazine.com/news/view/113339-Mojang-and-Bethesda-Are-Going-to-Court] that Bethesda have taken up against Mojang AB and there's a few threads already discussing it, but I just thought I'd encourage anyone who, like me, is angry and disappointed by Bethesda to send them a letter/email to let them know how we feel.

I think it's got to more effective telling them directly in a coherent and intelligent way than general raging on the internet. Hell they might even start to believe their playerbase has enough intelligence to know the difference between the juggernaught that is "SKYRIM: The Elder Scrolls V" and an indie game called "Scrolls" but that's probably too much to hope for...

Here's Bethesda's contact form [http://www.bethsoft.com/eng/contact_email.php] and just as an example, here's what I sent them earlier, though I'm sure you can all come up with better arguments:

Dear Bethesda,

Firstly I would like to say I am a great fan of many of your games, I have lost a large chunk of time to the worlds you have created and I greatly appreciate your contribution to gaming.

However today I?m writing to you in disappointment about the upcoming lawsuit with Mojang AB. I understand the importance of protecting your IP and would fully support you if I believed it to be in any danger, however in this case I am entirely unable to do so.

There are already plenty of people expressing why confusion would be ludicrous (not least Notch himself) but suffice to say, I find the implication that a single word similarity could confuse your audience between two such obviously different games to be borderline insulting, especially since your games are more widely known by their individual names i.e. 'Skyrim' rather than the 'Elder Scrolls V.'

While there are numerous other things within the industry I could complain about, the reason I am compelled to write to you is because I think that Bethesda has done far more good to the industry than most and I find it so disheartening to see this bullying behaviour coming from a company I have so much respect for. It is particularly upsetting to see a disagreement like this between two developers I like so much.

I appreciate that my own feelings are hardly important in the grand scale of things and that I cannot be entirely informed of the details, but I cannot even understand this from a business perspective. The general bad press and negative feeling that this has generated is likely to lose you far more sales and cause more upset than any confusion with the name Scrolls might.

Despite this, I still intend to purchase both Skyrim as well as Scrolls, whatever the outcome, but I wish (rather naively) that good sense could prevail and this disagreement can be dropped without further damage to either party.

Thank you for reading this, I hope that my argument and the numerous others that are being expressed have at least had some attention paid to them.

The developer is different from the corporate heads that make the decision, even so, it's terrible publicity, especially for a pc centric developer.

I think they'll just delete them all, but I'll send in a letter I guess...

Maybe we should just all mail bethesda bricks with the words "shitty decision" written on them?

/Shrug.. you could always ask "Hey Bethesda.. Shouldnt you finish harassing interplay with litigation before you go off sicking lawyers on Mojang? Or perhaps thats just what I would do.

Well they'll at least have to start reading them first before they delete them, it's better than nothing!

Like the brick idea, that'd be a nice succinct way to get the point across...

I will be perfectly honest. If this controversy hadn't exploded as it has, and one of my gaming friends came up to me and asked, "Hey, have you heard about that new game coming out? Scrolls?" , my immediate reaction would have been, "Oh, the new Elder Scrolls game, you mean? Skyrim?"

And I doubt that this is all so black-and-white as it seems. I somehow don't think the Bethesda legal team spends all of their time cackling maniacally and plotting to destroy indie developers.

Perhaps I'll send them a letter with my sympathies. Copyright law is tricky, tricky stuff. I feel like this could, in fact, be justified. We'll see what the ruling ends up being, I suppose.

Wouldn't mailing a scroll with said words on it be a bit more poetic and meaningful? Just a thought.

Yeah there's definitely 2 sides to everything but it's annoying only hearing the one, Notch has been so open about this but Bethesda have said nothing - I'm hoping at least I might get a reply with some explanation from them.

Repeating what I said in your other thread about this.

While I do applaud the sentiment I do believe that it's a vain attempt.

If all the people bothered by this on Escapist were to e-mail Bathesda in regards to this then thats likely to be about 10-20 people compared to the thousands it would take to get the attention of anyone worthwhile at Bathesda.

all these people complaining about Bethesda suing mojang really annoys me, i mean they kinda have to sue them for it or else they'd have no grounds when people who start publishing "the scrolls of the elders" and "nuke'd - new las vegas" say that they didn't defend their copyrights from mojang. if you wanna hold on to your I.R. you have to defend it from everyone, regardless of how much they are received by the public.


and mojang - when making a fantasy RPG whose title is basically half of the title of a famous, copyrighted fantasy RPG series without being suprised by the outcome doesn't speak well for your legal department. also - challenging one of the largest video game company to a classic 90's game to settle a dispute concerning intellectual property worth at least a 100,000$, well knowing what the internet and public will think of it - is just transparent and cheap.

Considering how often Bethesda has been blasting the SKYRIM horn this year, I'd guess that "The Elder Scrolls" part of the title isn't getting as much attention.

Still, I predict Mojang losing this case, sadly.

By character count, Scrolls is 25.93% of The Elder Scrolls V: Skyrim. There are many, many examples of closer title matches in various media, including games, that did not result in lawsuits. Given the difference in genre and the popular shortened name of Skyrim, it is nearly inconceivable that there will be confusion of the kind that will have a financial impact on Bethesda.

That's sad, but true. *queues up Metallica's song by that name and headbangs for no reason*

In all seriousness, though, I don't think we should go up in arms and claim Bethesda is doing this deliberately, with the intent of making a buck off of Mojang's back. You have to remember there's a clear difference between BethSoft and Bethesda Game Studios. Letters, flaming bags of poo or other such futile, if cathartic attempts at delivering messages should be sent to BethSoft, the publisher. Pete Hines et al. have literally nothing to do with that mess.

In fact, I'm sure someone in BethSoft's cringed at the idea of landing a subpoena against Mojang at least once. Skyrim's riding high on the hype machine, and I don't see how Mojang could conceivably cause BethSoft to lose sales. What, is your archetypal confused and non-gaming relative likely to buy you Scrolls for Christmas, instead of Skyrim?

That goes without mentioning that A) Scrolls looks awesome and I'd be happy if that kind of mistake happened and B) most of us know Skyrim as just that. Skyrim. I've never met someone who consciously and continuously added "The Elder Scrolls V" to the name, when talking about it.

Oh, and C) Scrolls is a download-only indie game. Skyrim will be pressed on silicon sandwiches a good couple million times, without counting the number of queued downloads. Even if Scrolls came on a physical medium, could you *really* stare at the two boxes in a GameStop and conceivably be confused?

There's no sales to be lost, here. Beth's legal department is trolling, literally and figuratively.

If they have so much money that they can spend that much time in court harassing some guy, I'll spare my own money and buy their games used. I sometimes send letters, but I just can't be bothered. Hopefully, they change their ways before Fallout 4 comes out. :p

I like that idea, but scrolls don't hurt as much when you throw them out the window...
