How do you not see it? Sony came out and said they're not restricting what you do with your games. You can lend them to friends without restriction. You can buy and sell your games as you see fit. If you're willing to condone Microsoft's ideology in exchange for some Kinect games for your daughter, that's fine. MS hasn't pushed you far enough yet, so you persist as a potential customer for them. I hope very much that you are in the minority, and I hope that this console fails whether you buy it or not. That's the only outcome capable of forcing MS to reverse course.
I guess the big factor is that none of the restrictions in place bother me because I don't trade games or lend them out. It would be a problem if they tried sneaking those limitations in but they were up front about it. My daughter is vastly more important than some fictional battle for my "rights." They are clearly targeting a very specific niche and I happen to fit it perfectly. I still expect the PS4 to outsell the Xbox One but I don't pick based on popularity. The group of people I play with are all in a similar demographic as me, as long as I can play with them I don't worry what anyone else does. And who knows, maybe sales will be low enough that Microsoft will change some things, it wouldn't really surprise me. I am quite confident the entire system won't be tanking even if sales are underwhelming.

If you're looking for some family-friendly gaming that your daughter can get into, then the Wii U is a clear contender. it has games based around local multiplayer, ideal for family gaming. Nintendo Land is a total blast with friends or family. It will have games like Mario Kart 8 and Smash Bros which are always a huge amount of fun to play solo or multiplayer. It will have adventure games that are enjoyable for kids and grown-ups, like Super Mario, Donkey Kong and Zelda. The only reason I am not getting it now is she's still too young to really grasp controllers and the like. Kinect really is simple for a kid regardless of age. My "dream plan" I guess you could say is to make it a special Christmas or birthday present in a few years when she really is old enough to be way excited about it like that N64 kid from YouTube. Then we can fight over who gets to play Zelda first, lol.

The only difference for you is kinect, which if you have a wife that like dancing and need kiddie games, then I say you have no choice. PS4 will have move 2.0 but you need a controller for that and who wants to dance with a controller? It wouldn't be tracking you, it would be tracking 1 hand.

MS are going to get dominated this year, so one more sale in there favor wont make MS think "this was a good idea"

Kid friendliness really is the deciding factor but the WiiU really doesn't do it for me as a gamer. I can see getting one down the line in addition to the Xbox One but nothing about it makes me crazy to play like the PS4 other two consoles.
Based on this part alone it seems you are making the correct decision.

Your games console is not solely "your" games console, more it is your families games console.

You want real console for core grade games (high graphics ect), so the Wii U is out. But you want all the motion and kiddy's stuff, the Xbox does that better than the PS4.

My games console is just that "my" games console, nobody else gets to touch.

For myself it looks like the PS4 is looking better (I don't care about used games or always online, though it does bug me Microsoft is forcing it, so PS4 is get minor points there, and of course the price is a +). But what I really don't like is motion control, I want to sit around and press buttons like have been doing for the last 20+ years. But integrating Kinect Microsoft is sub-consciously forcing developers to use it in there games just because its always there. Whilst PS4 having motion control as separate device means most developers wont add motions controls to games, the same as most don't bother with Kinect for 360 now. Limiting motion games to motion/kiddy type games and leaving it out of my core gaming.
