I'm sure things will change, but there'll always be room for the individual, and as for this whole 'prosecuting people for downloading or visiting sites', its pretty hard to prove someone downloaded something, unless you go around and actually find it on their computer.
Surely if I go to the library and download a metallica tune, and thus bring the whole might of the US legal system down upon me, wasn't it the library that downloaded it? What about if I chose to visit a non corporate or unpopular because of its views website, by driving around and leeching from someone else's wireless?
Yes there's bad things online, and something should be done, but just handing it over to corporations is like finding peeling paint on a wall in the orphanage and giving the keys to Michael Jackson just because he has the money to deal with it...
