Funny thing is, i actually thought of skyrim when i saw the new bond title... so in that sense the two COULD be confused;

whereas scrolls and the elder scrolls never blurred together even slightly.

Short version: Bethesda are idiots.

I wouldn't say that or else 900 angry fans will knee jerk you into not caring. I have been dealing that for the last 2 days assuming that Skills were going to play a big part in Skyrim.

Anyways, no, because the difference in media is the largest thing. No one can really confuse a movie ad for a game ad, especially since each will say what media they are.

Skyrim, Skyfall, Skyward Sword, Skyoshock - the list grows. This is why you shouldn't try to copyright a 3-letter word. They'd have to sue everybody.
The Fewer the letters, the more lawsuits. I think this is something a company should take into mind when copyrighting commonly used/short words.

reminds me of the search engine nexus.. where a result becomes so common that you cannot handle it

for example, Google generates

25,090,000,000

results for documents containing 'e'

that'd be a lot of lawsuits if someone copyrighted e right?

It's funny because when I heard that on the news this morning I had the exact same thought!

And so is ID Software going by this logic and Arcane studios.

The Bond films are based off the books by Ian Flemming (or at least they're supposed to be) and thus (I would assume) the titles are as well. Given this (possible) fact, if any legal action is taken it should be Ian Flemming suing Bethesda. Although why they're bringing out 007: Skyfall so close to Skyrim might be a point in Bethesda's favour. But no, no suing should occur, you can't sue for having a name close to the name of your product. There's no case.

Sorry about the ambiguity but I don't really know and at 12:40am I don't really have the strength to find out for myself.

People keep jumping at Bethesda over this but they are just defending their trademarks. Win or lose they still need to defend it to prevent a "The Oldest Scrolls" game form coming out.
Yes I know it's mainly about dumb trademark laws rather than trademark trolling by Zenimax/Bethesda. And that Mojang aren't entirely in the right on their handling of this matter.

However that would ruin my original "joke" :)
I guess so but it just ruffles my feathers when people seem to think that Bethesda are just picking on the little new guy just 'cos.

It probably wouldn't matter even if they called the next bond film Skyrim, because that's not how trademark law works. The whole basis is you have to demonstrate that there is a potential for confusion, but if the products are inherently different that makes litigation much harder.

I predict a class action lawsuit including but not limited to:

Skyrim
Skyward Sword
Falling Down (movie)
The Sky is Falling (movie)
I really hope they send the guy from Falling Down to Bethesda if they do that...Hey they could make a sequel from that. Falling Down 2: The Revengening.

I imagine that if though MGM was just bankrupt for a while... that they still have better lawyers than Bethesda. And it's Jame's Bond... no one would dare sue him.
