There seems to a general outcry from Nintendo and Pokemon fans going on here... whether it's a fake or not, I think Nintendo has some answering it needs to do for its fans. I want to see them defend themselves from their own fans.

The EULA of games today pretty much say that it is against the terms for anyone to share the information (data) of the game without the consent of the makers. When they published that information they are breaking the copyright.

when you buy a game, you do not buy the game. You do not own the information in the game. you buy a licence to use the game. When you buy that licence, there are rules that come with it.

these people are breaking the rules.
So in your world it would be illegal to import said game? To post a picture to facebook with some ultra rare pokemon from it? The hell?!

Problems with EULA's
1. you one see them only after purchase
2. if your under 18 can you consent to a legally binding document

Yes it is a huge overreaction. I bet their logic was "lots of people will buy the game to see all the new Pokemon, and since you can look at them all online, buying the game would be pointless." Yes it kinda makes sense, but anybody who doesn't buy the game cuz they saw a few pictures is a fricken weirdo. It's also possible that they simply didn't want there to be spoilers for those who haven't played the game yet- I know that I wouldn't want to see any new Pokemon before I discover them in game.

from what I have read Pokemon Black and White are suppose to be a sort of re-birth of the Pokemon franchise, and Nintendo wants it to be a surprising experience like it was back in the days of Red,Blue,Green and Yellow. Well, they kinda have the right to do this. It's just that it also kinda makes them seem like huge dicks. I'm quite sure people don't generally care any more whether they know or don't know what the next of the COMPLETELY UNIQUE AND INCREDIBLY INNOVATIVE critters will be.
Come to think of it, I really didn't care about any of that surprise stuff way back when I managed to plead and moan my mother into getting me a Gameboy and Pokemon Red.

well it isn't my world (if it had been my world Pokemon and all games would have received a world wide release), and yes it is illegal.

as for the EULA:
you buy it and you have been warned. That doesn't stop you from playing it and enjoying it. but you aren't supposed to be sharing that with people who don't have a licence.

And in most cases the licence would belong to the parent, and it is within the same household, so it is okay.

and I have seen people under 18 consent to a legally binding contract. A school syllabus for example is a contract. It pretty much states that if the student doesn't do their work then they will receive a lowered mark and in some cases fail. Student does their work, student doesn't fail. that looks like a contract to me.

and, for the record; why does nintendo always try and stop people from buying their games?! Isn't that mentioned in marketing 101, advertise why your game is good, not the other way round?

If this is actually real then what is Nintendo's damage? Free publicity for an overseas audience that likely won't even see official promotional material until next year can only serve as a good thing.

Granted, if the sites in question used ROMs to find the sprites then that's some-what wrong, but it's they're both fan-sites that pride themselves from having the most up-to-date information on the games. In the cases of B&W the western site contributors would need ROMs to stay in the know.

Granted using ROMs is still illegal and in that sense wrong, but whose to say that once they'd gathered the info necessary they wouldn't go on to buy the official western release?

Beyond that, how the hell else do Nintendo intend for their western audience to get hyped for the game?

I'm not entirely sure on this because I've not really properly looked into it, but when it comes to Pokémon releases in the UK I've never seen it go anywhere past one TV ad...
That is the extent I've ever seen for Pokémon promotional material on our end of the world...

In Japan they have entire TV segments filled with it, Gaming magazines dedicated to it a campaign that reveals new monster every-so-often.

What does the Western side get? an official TV ad, the occasional article in a gaming mag and whatever else we can scrape up on the Internet.

Let's face it, these sites Nintendo targeted make up about 70%-80% of the Pokémon game hype on the western front.

Its a fucking game. Dont get me wrong, I love Pokemon, but its a GAME. People are ALLOWED to post information on it, to share photos, make fansites, etc.

What WOULD be a violation of your IP would be to take your Pokemon or mechanics, and put them into their own game, or something along those likes. Its not illegal to take sprites, pictures, or videos of a medium, so long as they dont have the intent to sell.

-AND- considering Serebii and PokeBeach are FREE and dont require you to pay a membership, Id have to say you ate a dogshit bullet on this one Nintendo.

HOWEVER, I would like to ~kinda~ thank Nintendo. I want Black/White to be relatively spoiler free, since I dont want to see all the new Pokemon (doing so for D/P kinda ruined some of the fun)

not quite, our pikachu is made up of 7 characters, in japan only 5 are used, although it sounds the same when you say it.

multiply that with every bit of text in the game and in several languages and you have a rather big job on hand.



although there is (in my opinion) no reason why we can't have a worldwide launch if all the translations are done before the japanese launch.
also, more on topic, i also beleive that this is a ploy to stop everyone seeing the new pokermon before they get the game. the copyright infringement claim was far too specific in that it only covered images from black and white.
