PHOENIX -- An Arizona couple accused of sexual abuse after taking bath-time photos of their children and then trying to have them developed at Walmart are suing the state and the retail giant.

Lisa and Anthony "A.J." Demaree's three young daughters were taken away by Arizona Child Protective Services last fall when a Walmart employee found partially nude pictures of the girls on a camera memory stick taken to the store for processing, according to the suit.

The Peoria couple's attorney said Walmart turned the photos over to police and the Demarees were not allowed to see their children for several days and didn't regain custody for a month while the state investigated.

Neither parent was charged with sexual abuse and they regained custody of their children - then ages 1 1/2, 4 and 5 - but the Demarees claim the incident inflicted lasting harm.

The couple is seeking undetermined monetary damages from both Walmart and the state and have requested a jury trial.

Richard Treon, the lawyer for the Demarees, said the images of the girls were part of a group of 144 photographs taken mostly during the family's vacation in San Diego.

There were seven to eight bath- and playtime photos of the girls that showed a "portion or outline or genitalia."

"There was nothing sexual about it," Treon said. "This is a parent's worst nightmare."

One lawsuit names Arizona, Peoria and the state Attorney General's Office as defendants, claiming that employees from each defamed them by telling friends, family members and co-workers that they had "sexually abused" their children by taking pornographic pictures of them.

A second lawsuit, naming Walmart as the defendant, says the company is at fault for not telling Anthony Demaree that it had an "unsuitable print policy" and could decide to turn any photos over to law enforcement.

Calls to Arkansas-based Walmart and officials from Peoria and Arizona seeking comment on the suits were not immediately returned Thursday.
I'd really like to know what people here at the escapist think about this. Are people really this paranoid that you can't even take pictures of your OWN kids without being accused of sexual abuse? It's normal for parents to take pictures of their kids in the bath when they're young last I checked. I honestly hope they win the case.

Pictures in the bath...isn't that standard? How else will you embarrass your offspring in front of their significant other in the future?

I hate people who can't differentiate normal picture taking by proud parents from pornography

I hate Wal-Mart

I hope they get as much as the law allows...

Definitely not wrong. But at the same time, the lawsuit seems pointless. Though I'm not a parent, whats the point of taking bathtime pics anyways.

what are you talking about? this isn't even on the subject of pedophillia. These are parents that took pictures of their kids in a bath. My parents took pictures of me in the tub as a little kid. So did every parent of EVERY PERSON I KNOW.

What you said is... well, to be frank disturbing as hell.

Oh I don't know...memories? You don't have some embarassing photo of yourself that your parents took when you were little? Something that, when the photo album is busted out, you'll be sitting in a corner, hoping nobody notices that its actually you in that picture?

Besides, this whole thing is blown way out of proportion. I think that its fine the Walmart employee said something, but they really should have looked closer into it before they took the kids away from their own damn parents. I mean honestly, its a little ridiculous.

(no offence to you normal americans, i'm referring to the general stereotype)

well i think kudos to the parents for sueing walmart, though really they dont have much of a chance, seeing as they're fighting against a corporate giant with the best lawyers, mountains of money, etc...

This is just sad. Every parent has pictures of their kid(s) running around naked. I have several in my scrapbook. My mom used to use them to embarrass me in front of friends (especially girls).

Don't know, but my parents did it and no one made a fuss. So has nearly every parent out there. It is something about the cheerful playful way they splash around that just catches the hearts and mind of a parent to the point they want to forever remember this special moment. I honestly don't understand it but then I have never found the idea of having children all that pleasant myself and so maybe can't understand the 'pride' at seeing them splashing around in a quarter inch of water.
