Well I was just having lunch and decided to check my Email when this just caught my attention right off the bat!!

4-Year-Old Can Be Sued, Judge Rules in Bike Case

I swear, Americas legal system is so fucked up beyond belief. I studied law for 4 years at university and seen my share of ridiculous UK laws, but America takes the fucking cake.

The 4 Year old shouldn't be sued directly for it, but if the old lady was indeed injured, then the parents of the child should be open to a lawsuit. I mean, they should have kept in eye on the kid.

Seriously, morality doesn't even kick in properly until around the age of 6 anyway, how the hell can you sue a 4 year old child, they'd have absolutely no idea what happened.

I hate lawyers with a passion. Especially the kind who'd work on cases such as these.

Kind of. It's not like the kids were known trouble-makers whose parents don't give a damn, it was an accident, for all we know the parents looked away for a just a second.

I really hope my friends Matt & Trey come across this and, well, tear the whole subject a new one.

On a more serious note, though, that is sickening. Blaming the parents, sure; but blaming a 4 year old child for something it most likely doesn't even understand?
I've heard of "go bowling, get wooden splinter in toe, sue the bowling joint for millions" scheme and similar ones, but my word, this is even more retarded than those!

The woman got hurt and a lot of people run out of money after they retire. Not to mention that if she isn't at fault, then why must she be the only one to pay for an increase in her insurance because of a parent who wasn't paying attention to where their 4 year old was riding her bike? And that is IF she survived, which she didn't. Now her hospital bills fall to her family, who have no one to blame, but a 4 year old who was racing her bike against her sibling.

It's not petty in this case, more so it's putting blame where blame belongs.

In the case where negligence over children that resulted in the death of an elderly lady, its much easier from a legal perspective to for one estate to sue than to debate the complexities of wrongful death. Blame the lawyers all you want but the smart money goes for a suit against the children and not the parents.

This nothing... in America a woman sued her dog to get her husbands will( the husband left the will to the dog because it was more loyal than the wife...and a lot less of *****...even though the dog was female)

I completely agree, hell. They probably don't understand what death is, it's not like she done it on purpose. Seriously ****** up this case is.
