suffering a hip fracture that required surgery. She died three months later of unrelated causes.

I am gonna say this is a WTF moment, but, the kid caused a woman to die. I think it's fair that people should be allowed to try to get some form of Compensation. Though it is a bit extreme to sue a 4 year old (or even allow that), it is justice...

Now to play devils advocate for a minute here, regardless of intent or age or anything like that ,someone caused damages and probably left a hefty bill for the dead woman's survivors. Now is it more right that someone pay a bill because a relative of theirs was injured and died or someone who caused the accident paying the bills. It might be better to debate American healthcare policies.
Those of you saying "sue the mother" i would want to consult with a lawyer on this, but im 98.6% sure you cant do this. Most parents would probably end up paying off any ruling by the courts, but they cant be sued for someone else's actions. This prevents things like parents losing their house because there live in son didn't pay his car insurance which has happened more than once in Toronto in my lifetime.
Not saying there aren't stupid flaws in the system, or that the survivors of the deceased wont make this into a cash grab, but we dont even know if the lawsuit is to cover medical/funeral costs or for a hundred billion dollars of pain and suffering.
I still find this less frightening than Alex Chapman suing Lori Douglas for $7,000,000 because her husband showed him naked pictures of her.

They're just going after the parents indirectly, the fact that the children are named isn't such a big friggin deal. Let's find bigger things to scream WTF over. Whatever they hit the kid for the parents wind up paying, makes sense.

Maybe they'll keep the little bastards from running into people in the future. Do I have a great start on being a grumpy old man or what?

All it takes is that one second. It's harsh yes, but a lot of lawsuits occur because of accident. There are a number of cases where a person sues an owner because their dog bit them. A lot of people get sued for accidental traffic collisions. It's a harsh fact, but its a true one. There isn't anything broken with most of the US laws or the legal system, but in this case, I do believe the judge to be wrong with placing the lawsuit on the 4 year old over the parents.

Yeah and someone can walk in my yard with out my permission get hurt and sue me. No our legal system is screwed up badly.

yeah... Too bad Toronto's not in America. Thats why we have that thing called Liability Insurance, Medicare (which, at 87, I guarrentee that woman was on), and public health insurance. So yeah, they may get the Premium, but its not as hefty as you would think.

Um no she wasn't. The article clearly states that the woman died of "unrelated causes". And 3 months later to boot.

The justice system is a fucking joke. And in a society so fucking obsessed with money, pumping out greedy scumbags like they ordered too many parts and they are trying to use them up, this kind of shit is bound to happen.

It sucks that this had to happen to an old woman, and that, I think, is the real problem. If it were a fellow in his 20's, the mother would've said "I'll keep her under control from now on," the kid would've apologized, and the young man would've been on his way. Since the old woman's hip broke, it's suddenly a big deal.
In short, and I think this phrase sums up the situation absolutely perfectly: Shit happens.
