"Terms and Conditions" when you download illegal software mean nothing.

I'm not downloading ROMs. I have never download a ROM, as possessing and using a ROM is illegal under copyright clauses. However, i downloaded a program to back up the functionality of my ps1. Which is totally legal. Now that my ps1 no longer works, I use my ps emulator to replace and continue the functionality of my broken ps1. I use actual ps1 discs in my pc disc drive and run them on a backup of the programming in my ps1. Which is completely legal.

Please apply some common sense to this topic.
I have ePSXe installed on my computer, is this illegal, the answer is no because the process of creating the software is no illegal nor is the process of distributing the software.
ePSXe is made to play original PlayStation One games, why might this be illegal.

If I were to play backup copies of games I owned - this can be considered as legal because I own the original media and I could argue that I use the backup copy because I want to preserve the original media.

If I were to use backup games without owning the original media - this would be illegal because I have obtained a copy without any payments to the copyright owners.

It appears we have a thread almost full of thickos here, so I'll be blunt - in no way is emulation illegal. Proof? The fact that Nintendo uses the Virtual Console, Sony has the Emotion Engine chip, and Microsoft uses whatever the hell they use. Furthermore, were emulation illegal, then programs like ScummVM, DOSBox, WinUAE and the whole bloody lot would be illegal to download.

Depending on where you live, backing up your legitimate copies is not illegal. What is illegal, on the other hand, is downloading game files that are still covered under copyright law (and yes, that goes for abandonware as well).
