Yeah, yeah, another piracy thread. But the issue came up in this Lifehacker post [http://lifehacker.com/5510752/do-you-pirate-media-you-already-own] and in the New York Times recently. An illegal download is still illegal, but would it be unethical if you already own a copy?

Ahh Piracy. never get sick of this one

Straight off the bat, I have downloaded songs, hunted for abandonware and games that are no longer produced, and aquired them in ways contrary to the licence. This makes what I'm about to say sound really hypocritical, but you know what? I don't care

Software licences, more often than not, specifically state that you are allowed to install ONE copy, and make ONE copy for backup, making three copies total. So you are within your rights to create/use a backup. Most other things are outside of the licence restrictions

But Jim, What If I sell my copy?
When you sell your copy you sell your licence as well. As long as you uninstall your copy and get rid of your backup, legally fine

What about music/movies Jim? Can I copy those?
Tricky. Music has been the dark horse for a while in this argument. A lot of people think that music should be free and that artists should be happy people are listening to them at all. This is, of course, total bollocks. People should be paid for the music they make. iTunes is a good system to start with, and a lot of artists give stuff away for free anyway. Backups of music are, well, kind of inevitable. mp3's are much easier to deal with in almost every situation where we used to use records/tapes/cds. So even if I didn't like it (and I don't) there's nothing I can do with that. We have to rely on people's good faith when it comes to actually paying for what they use. Which is essentially the worst business model in the world.
As for movies, people have been doing illegal things with them for years. Have you ever seen a movie at a friend's place? Criminal. Ever taped a movie off TV? Very VERY illegal. DVD copying was just as convenient.

If I own a piece of software/cd/music, why shouldn't I be allowed to do what I want with it? I mean it's mine right?
Well, not quite. I mean, sure you hold the physical copy and you can use that as many times as you like, but it's not really "yours". There are specific terms/conditions associated with whatever media you buy, that allow you to use them in a certain way. Quite simply once you buy it, unless you follow this licence, you are breaking the law

Isn't this a little much?
Yes. It's a lot of stuff to put up with without any real justification other than "Because we want to earn money". Unfortunately we don't have a system in place that is fair that everyone agrees on. The people putting out the media feel they deserve some pittance for their hard work, whereas the consumer has been burned too many times. Somewhere there's a fair solution where we all get what we want at a fair price

Ethical in my eyes. Use whatever justification you like, bottom line, they already got their fair share.

Actually, I remember reading about this one law case that said that it's not against the law to pirate things as long as you have legitimately bought a copy of the thing you're pirating.

I would. Especially if my copy of Michael Bay's Whatever: The Movie stopped working for whatever reason. I already bought it and I'm getting my money's worth vishnu-dammit!

I think so, although I wouldn't make a habit of it.

For example, I used to own Grim Fandango, then I lent it to a friend. Never got it back. I'll probably trawl through some abandonware sites to find it again, because I can't find a place where I can buy it.

And like hell if I'm giving some douche on Amazon US$140 for it.

I do, for sake of convenience. For example, a CD for a band not released in this country yet. I'll pirate the CD and then buy it later to support the artist, probably never even opening it. So sort of the other way around, but yes I do pirate things I get legitimately.

If I bought it, and was then not allowed to play, you bet I would. Or if I download something, then buy it. Of course, if you own a physical copy, you can legally own a copy of the digital version where I live.

Oh God, I thought you were joking! Is Grim Fandango rare? I'm pretty sure I bought mine from PC World last year for like a tenner...

If you think that's bad, you should see what they're asking for American McGee's Alice.

Yes. That or if a company cannot make any money off of said item. For example, Square cannot make money off of the FFVI game at this point (most recent port is GBA I believe), so what's the crime?

Er... Yes? I thought this was legal. It's legal in Canada for music, anyways. Hell, it's legal here to download music you DON'T own.

As for the OP, I would rather download someone else's movie that they uploaded than rip it to my computer myself.

Yes I would, in fact I have I bought a copy of Dreamfall: the Longest Journey off of amazon for about two quid but when I uninstalled it the starforce copy protection simply wouldn't let me play it, so I check for solutions online after I attempt a few and none work I yelled angrily to the heavens FUCK IT!
I downloaded that fucker in less time than it took the real copy to arive installed it and it worked fine, but here's the kicker that was three months ago and I still havent even played the get because the very idea that the DRM can be incompatible with vista but the game works fine pisses me off so much.

I had that same exact problem with my copy of KoTOR. I'm currently running that game with a crack, because I fucking own it already. Stupid DRM.
