Not quite, as far as patents go, as legal entities like a company or Associations can not legally own a Paten, only actual individuals at least this is the case for US law is concern.
And it has no bearing who developed the item patented, just the person who's name on the paper work. The Association might be in charge of handing out licensing, but this has no baring on the patent holder. Silliness indeed.

I don't know how Japan's monopoly laws and market is, but I do know that in the US, it's completely different, which leaves both Nintendo and Sony untouchable by the Anti-Trust Laws. While Microsoft is an United States based company therefore, as a legal entity under the government business associations, they must abide by the US based laws. It's why they are still alive if it weren't for Linux and Apple, as those companies created 'competition' for Microsoft to continue their business activities.

And if Microsoft and Sony teamed up(Something that really, really, really won't happen unless the heads went crazy) to make a single console, that would put two consoles on the market. Two consoles is not competition, and since they would mainly be from out of country, Microsoft would most likely be told to separate from their endeavor to make a cooperated console.

Two consoles on the market? I don't think many gamers would care, but it would be a definitive Lose situation for most people involved; gamers, publishers, and developers alike.

It would be the most intelligent thing for both companies to do. Mergers in the business world are a common thing no matter what some gamers here think. But, let's just see if both companies are intelligent enough to do it....=/

Kinda of hope they do just to see all the fan boys from both sides reactions to the fusion of the consoles, plus i wouldn't have to worry about getting screwed on dlc/exclusives anymore.

Its a superb idea, and this is merely speculation. But the chances of two of the biggest games console manufacturers doing us, the consumer, a favour like that?

Ive got more chance of being shagged by half a dozen fictional characters of my choice.

It is possible that the Next Gen Console from both companies being one and the same?
If so it will be Sony designing and manufacturing the hardware and Microsoft doing the software development tools and online services? It would be the best of both worlds.

Interesting, there will be no competition in the market if this happens, meaning they could charge anything over $1000 or more. I would in theory like that there are no more exclusives, since there's just 'the' console (forget Nintendo obviously), but without competition, even going forward, game prices may be higher, I'm not sure I like this.

Also, all my favourite exclusives are Sony ones anyway, so I don't see a benefit of having smeg Microsoft software, since they usually don't do a very good job beyond Windows or Office, Sony's UI is much nicer imo (and without those stupid avatars), and yes, I had a 360 I traded it in for a PS3.

I'd sooner see Sony drop out of videogame business altogether. That is if business gets tougher; they are already behind Nintendo and M$.
M$ can hope to compete to that end, because no anti-trust issues will follow M$ if they don't need to merge.

There's less at stake for Sony than for the other console companies. Sony merely got into this business to get revenge on Nintendo for bailing out of their CDROM deal.

The other 2 have major stakes.
Nintendo = videogaming.
For M$ it's a little more complicated. M$ = windows. Easy xbox-PC ports = preserving PC gamers = early hardware adopters = new windows versions installed = everyone else to follow.
Games are the biggest drive behind the hardware race. At some point that new hardware requires a new OS, which is where M$ come in.

For Sony the Playstation brand is just a tiny facet of their giant company. I think Playstation is very good, but Sony just don't sell enough.
It's sad, but the best product usually loses, because it's a little bit more expensive. Blame consumers, but there's no way around it.
PS3 - best console, no RRODs, not last gen, also third place.
PSP - best visuals, best controls, no gimmicks, loses to the DS and even the overpriced iPhone is a bigger platform.

This sucks and if things don't improve for them or even get worse that's a reason to abandon those quality hating barbarian gamers and do something else. Making great consoles and selling them at a loss for several years is tough.

Nintendo have it easier because they have no interest in making the fastest console, just the cheapest one they can get away with, and as for M$ the hardware race totally fits their overal strategy even if it costs them money.

Should also note that there are 17 companies that hold patents that are considered 'essential' to Blu Ray technology... and while Sony hold the patents for most of the actual media (disc) most of the player patents are held by Panasonic.

Of course, when it comes to replacable media the real cash is in the media not the player, so Sony and Phillips would be getting most of the royalties off of disc manufacture. However, those royalties go to a completely seperate division of Sony from the one responsible for manufacturing consoles... which makes it as non-sensical as claiming that every copy of Windows 7 goes to Microsoft (which it does) and infering that it will go directly to the division responsible for consoles (they wish).
