What, did nobody else get spanked as a kid? Seriously.

I have old school parents like this and my dad had a massive paddle with holes in them not a nice little belt, you know. I cried and screamed too, didn't every kid? Granted the dad in the video was being a massive prick but she was also 16, come on. From reading that article I guess she has cerebral palsy or something.... So? Thats not a brain-altering mental disorder or the reason why he was spanking her.

And it happened 7 years ago! This is a family dispute! And a minor one at that! This shit wouldn't have flown in the media (or anywhere) 10 years ago.

This is bodily injury? Ha, I guess I should sue my dad and most of my friends then. And several of the guys on the soccer team too.

What?

I can't believe this has been up for 45 minutes and nobody has ripped you a new one over it yet. All I have to say is, prepare to have your inbox blow up -- mine blew up just for suggesting that the title of the thread was hyperbolic, and the truly severe abuse is being ignored in favor of what we're seeing here.

I was taught to respect my parents without fearing physical abuse. Granted, that didn't work with my brother, but I'm sure corporeal punishment is not as 100% effective as people who had it done to them claim it is. If it were so, we wouldn't have so many studies showing its ineffective.

My parents were the least strict parents in the world. This let me respect the few rules they did keep because I was generally free and they were generally rational. I was told not to lie, and my parents were completely and absolutely honest with me in return. When my dad divorced my mom, he asked me personally what I thought of it beforehand because what I thought, even at 14, meant a lot to him. When I ended up in the hospital in grade 12 after drinking too much, my parents told me stories of their mistakes and how they understood that at my age we don't understand the consequence of such things. That made me understand that I need to watch my self without making me feel guilty or being hurt by them.

I can name many stories like this. Now, my parents were far from perfect, but I credit them with raising me and my sister properly without the threat of physical violence. Maybe its because my parents were young when I was born (they were 24).

What do you mean to much time has passed? That's fucking bullshit. This sort of "statute" doesn't apply to rape cases, why should it apply to those pertaining to physical abuse?
It does in some places. Here in New York for example, it's 5 years. I'm pretty sure the only crime that's universally not covered by this kind of statute is murder, but then again there may be exceptions to that too.

I'm not saying parent spanking (or anything else physical) their children is a good way to discipline children but its not uncommon. And in this video she's 16. 16! The last time I was spanked I was 8 years old because I wouldn't listen if I didn't live in fear of it. As I got older it transitioned to stern talking-tos and groundings.

My overall point is that I don't understand why this is in the news at all(the story this thread is all about). Yeah, the dad is a dick. Yeah, he hit her in the arms a few times and threatened to hit her in the face. So? Worse things have happened and will continue to happen.

But I guess this 23yo is somewhat of an attention whore (yes, she is or else she wouldn't have posted this video on youtube at all) and the collective media doesn't get paid enough to spend their time finding better stories.

I think it is because the guy is a judge and in the anglo-saxon world there is this myth that judges are wise men who are paragons of their community. That is less true in other parts of the world where the roll of the judge is heavily restricted.

What, does nobody think that the President (and by default all past Presidents) ever spanks his kids? This is a bit beyond just spanking but do you think he probably wouldn't have yelled at her so much or hit her as much if she would've just bent over and "taken it like a woman"? <- I'm qouting the mom from the video, btw.

To be honest, I wouldn't mind if our county judge or whoever did a kilo of smack every morning for breakfast so long as he judged fair enough.

Besides aren't all judges in the U.S. elected in? That would make all the people who kept re-electing him all these years responsible because they didn't do a very good background check on him if they have a problem with him now.

Basically so the justice system doesn't get bogged down with relatively minor stuff from years ago when there are much more pressing concerns in the present. It sucks but that's just the way it is. If it's any consolation this is probably a career ender for the guy.
Indeed, his public and private image is very likely shattered and he'll be lucky to land a job mopping floors. I suppose that's some form of justice, eh.

Exactly! So why would the people want to take responsibility when they can blame the judge? What I was referring to is not what is rational, such as your point that as long the judge is good his personal life doesn't matter, but what our society assumes. And the myth of the good judge is one of those things we internalize when we learn about the way the law works.

And no, I don't think anyone imagines Obama or Bush beating their children. In the same way, I'm sure nobody thinks of them farting inappropriately, sitting on the toilet with a bad bowel movement, or having kinky sex with their significant others. With some jobs, we have certain stereotypes we assume they make true somehow.

But they're similar. All three can cause lasting psychological damage that can negatively affect the quality of life of the victim. This decision also makes no sense. What changes occur in five years that warrants a case dismissal? The crime was still committed and no amount of years will change that.
Well yes, but the problem is rape and murder are pretty well defined.
What is physical abuse? If I give my kid one slap after he broke my 2000$ TV I just bought and saved for for over a year does that justify that I can get charged with domestic assault ten years later?
It is physical abuse after all.[/quote]

If you honestly believe what the judge did to his daughter is equal to slapping a child then I think this discussion is over.

Honestly ?
If you were beaten by your dad often and bad enough, using a special beating-instrument that he apparently liked to keep around, that you accepted it as totally normal... uhm, yes, you actually should consider suing him and, much more importantly, possibly get some kind of psychological help.
And I´m not kidding.
I grew up in what I would consider a reasonably normal household and reading your post actually distrubed me (especially the "I cried and screamed too, didn't every kid?" part.)

P.S.: I realized that it might be prudent to add that I´m from a country where physical violence against your children is actually forbidden. So that might inform my opinion a bit.

He has as much connections as anyone else has, considering it was on statute of limitations.
The article even has the people acknowledge that he committed a crime, but the law is a law is a law, no matter how stupid it is.
the statue of limitations is set up because people forget things and crime scenes change since this is video evidence it shouldn't apply to this.

Not all. A lot of the higher positions (including the entire Supreme Court) are actually appointed, not elected. Sadly enough, the ones that get appointed have a better vetting process. It's a non-partisan election, and the incumbent, who has no term limit, almost literally always wins. It pretty much takes a scandal on the level of the one we're seeing here to get a judge voted out of office, and even then it's not a guarantee, because literally the only thing you see on the judge portion of the ballot is a name, with no party symbol next to it, and usually no campaigning before the election, meaning you've got a list of total dark horses.

Edit: And that's assuming it's even an actual election. Most election years, the vote is about whether or not to retain the current judge; you only get an actual election if the judge gets voted out.

I don't give a fuck if it passed the five year limit. He should still be charged for what he did. Preferably with the death penalty, as bass-ackwards incestuous hick fucks like him do not deserve the right to breathe, let alone breed.

Good God, man, listen to yourself. He beat his daughter; you called him a "hick fuck," and said that all such people need to be executed and prevented from breeding. Who's the "hick fuck" here, again?

Edit: Or am I the only one who sees the irony that the issue here is that this man employed corporal punishment, and in turn, you're trying to escalate to capital punishment?

There is not a damn thing in the video that should be considered anything near abuse. That was a father (a judge mind you) disciplining his child for breaking the law and disobeying him. He did not go overboard. She refused to accept her punishment for pirating music, which we can assume is against his own set of rules on top of being illegal, and was punished more severely because of it.
