Hi,
I work at a hotdog stand in a small town in connecticut. The place is over 80 years old and is the only one of its kind anywhere in the World. We have a famous relish and a building with garage doors on the front. For 70 or more years we made the relish from scrath behind the restaurant and no one ever complained of getting sick. For 79 years we opened the garage doors in the spring summer and fall to keep the restaurant cool and it allows better access to the small restaurant. The Health Department came in and told us we could no longer make the relish ourselves, and it is now made at a manufacturing plant a couple towns over. This year we were told if we were seen with the garage doors open again we would be shut down.

The point i guess is this: Neither of these things that the health department "fixed" had caused any problems...so why then do they feel the need to change things based on a "what if"?

Why is it that organizations like the health department look at what could theoretically happen instead of the facts of 70 years of what didn't happen?

Well these days people are suing over anything you can think of, so you should be happy that the Health Department made you do those changes before a money seeking liar comes in claiming you made them sick.

That sucks man. You have to learn that while most people who get into positions of power are clever in the sense that they can worm their ways into those positions, they are not clever when it comes to such things as common sense, risk calculation and general intelligence.

the health department...i assume the division on the Connecticut government that monitors the health safety of restaurants.

I don't know what reasons were given for having to make the relish in a new place...i assume it is because we dont have "sterile equipment" or something.

And as for the doors their reason was bugs/flies...

I don't think their reasons matter when things have been done the same for 80 years...there are just as many flies and other bugs flying around now as there were 10 years ago when it was perfectly ok.

the answer? read up on every official rule so that you understand them better than these officials so you can keep your establishment on technicalities

that's the only reason im considering studying law at uni

Health and Safety nowadays has gone too far if you ask me. I suppose it's because of all these dicks that sue companies because of something that was their own fault.

You know 80 year old buildings are likely to to be in worse condition now than they would have been 80 years ago? Not to mention the total change in knowledge of what makes safe food preparation and the diseases that can come from it. Really if people have not worked to keep the building in form it will be their own fault. Health and safety regulations are not kept hidden away after all and this probably was not the first visit. Also the job of the health department should not be to fix problems as by then it is far to late instead it is to stop them from happening.

Also to any one moaning has any one heard of food poisoning? Also on suing that is the least of your worries, one good health scare and that can wipe out a business.

What's surprising? America moves towards Socialism which means an ever increasing burden of pointless burocracy.

All governments want more and more power even over the pointless things. Vote Republican, it might get a tiny bit better. But I doubt it.

the building isn't 80 years old..it burne down in 1945 and was rebuilt...and a year ago we renovated it with a new steel frame etc etc...

as for food poisoning...thats always a risk in any buisness but pizza parlors make their own dough...bakeries make their own stuff...

It's like people being told that standing/sitting in front of doors is a fire hazard and they must move. Like they'd still be sitting blocking the doors if there was a fire....

chances are if you are allergic to something, you've been checking ingredient labels for so long that you would know that relishes tend to have vinegar in them. Or you would ask. My cousin has a peanut allergy and there is no diving in trying things out of the blue.
