I don't think their reasons matter when things have been done the same for 80 years...there are just as many flies and other bugs flying around now as there were 10 years ago when it was perfectly ok.
You know 80 year old buildings are likely to to be in worse condition now than they would have been 80 years ago? Not to mention the total change in knowledge of what makes safe food preparation and the diseases that can come from it. Really if people have not worked to keep the building in form it will be their own fault. Health and safety regulations are not kept hidden away after all and this probably was not the first visit. Also the job of the health department should not be to fix problems as by then it is far to late instead it is to stop them from happening.

Also to any one moaning has any one heard of food poisoning? Also on suing that is the least of your worries, one good health scare and that can wipe out a business.
the building isn't 80 years old..it burne down in 1945 and was rebuilt...and a year ago we renovated it with a new steel frame etc etc...

as for food poisoning...thats always a risk in any buisness but pizza parlors make their own dough...bakeries make their own stuff...
If the building was redone a year ago and they did not comply with health and safety regulations? Really that is their own damned fault. I would also point out unique does not equal good either, I mean iron filings in relish is unique but I would not not say I would want that, oh sure loosing the unique style might be sad but good food preparation is far more more important. Yes any business that makes its own stuff runs a risk of food poisoning but the reason why health and safety exists is to minimise that risk. There is no point moaning about it if you where not keeping to regulations no one else is to blame so live with it.

That and really a case of food poisoning will do a lot more harm than this nonsense litigation. It is instant bad press and really would you go to a place that is meant to give people food poisoning? A lot of places have been brought down like that, no matter how big they where before hand.

That is just stupid, you hate health and you also hate safety? What a load of crap.

I've got a "Meh-Hate" relationship with them. Yes, stop products going to shelves that are designed to knock in a nail and instead gives me an accidental bit of brain surgery (and not the surprisingly pleasant kind of brain surgery, either). No, don't try and make regular, reasonable people safe from non-existent threats and imagined troubles.

I ate your relish, it made me very sick, I miss work, take you to court, you are out of business. All because you made your relish or whatever in a potentially unsafe and unsanitary enviroment. That's really all there is to it.

Or, I found a dead bug in my relish, did I put it there? Maybe, maybe not. Who's going to get the blame: the paying customer or the person making relish outside?

I live near the amish who bake all their stuff from scratch and sell their food surrounded by flies and I've never seen the health department knocking on their doors. Not that I approve of this, but as you said, if its not a problem the government really has no reason to step in and "regulate." There's more important things they should be wasting their money on.
