Just like most people say, they can say as much shit as they want because there is no penalty. I mean words can't hurt you or even technically ruin the game, so there is nothing infringing their ability to say whatever they want. Just mute then, simply as that, and yes if you're tired of that attitude just report those people if it gets that extreme and you might reduce those encounters.

Microphone+anonimity+lack of retribution=Absolute freaking dick who will push every little gripe and insecurity they have onto you because they can and there's nothing you can do about it. that's about the long and short of it.
OSN and XBL's admin systems are pathetic, people who behave like that on PC games tend to get banned within seconds. Sorry to be a self righteous pc dick but it's true. XBL and PSN needs some kind of user based admin system that works immediately, even if it just prevents specific players from joining a game you're already in (or prevents you from joining a game they're in).
An 'I do not wish to play future games with this user,' button is the only way I can see it working, since there's no fair way to actually ban players, maybe players getting a lot of those flags on their account could be investigated. The current system takes too long if it works at all.
I totally get what you're saying but I don't think it's an issue of lack of effective adminship, I think it's the fact that the PSN and XBL admins don't consider trash talking of that sort a problem that should be forbidden. I mean think about it, they are not actually ruining the game like hackers and glitchers do, so they are not really causing any harm iwht their words, therefore they are allowed to act as much of a dick as they want. How would you feel if you did not have the right to say whatever you want? Yes I know it's an abomination how people abuse this but oh well it's a right that XBL and PSN gives us.
Just remember, if someone acts like a dick and you totally own them, it's satisfying to get back at them by being a dick and gloating your victory over them.
