No. They would never let this happen. A representative from somewhere else would be brought in. They take this stuff seriously

*recluses himself on grounds of impartiality as outlined in the ethics code of my practice.*

No actions can be taken against me, and the case will be held, within the confines of providing the defendant with a speedy trial, at such time as a lawyer may be provided to him by the state or by my firm.

I'd represent him, if only to prove that I am a stronger man than those who would seek revenge.

Consider the situation that you are a highly esteemed legal representative who is currently grieving the passing of your most loved relative. This relative was killed, though it was accidental.

The killer, a middle-aged man with a wife and 3 children was rushing home due to a family emergency at night down a poorly lit road. Your relative, returning from a visit to a friend, stepped out onto the road without checking due to this road being vacant most of the time.

The driver attempted to swerve to avoid your relative but their reaction time was too slow. Now, due to a mix up in you particular company of employment, you have been given the job of representing the accidental killer at court and due to staff shortages it is not possible for you to pass the job on to a colleague.

Now, this is the killer of your relative, but it was accidental and he has a family. Do you accept that it was an accident that could have happened to anyone, and fight his case to the best of your ability so that a family does not lose a father; Or do you let the grief of losing your relative take over and do a shoddy job of representing this man, let him go to jail, a family loses their father, you risk losing your job and possible legal action against you.
I don't know where you are from but in the US that would be illegal for you to represent the guy. In some states people have stayed up to four years in prison waiting for trial because of an understaffed court system.

OK, the only information I have as facts are that my relative is dead, this man was responsible, and that he clearly swerved to avoid 'em. Based on that, I'd represent him to the fullest of my abilities, and see how it went seeing as the guy clearly didn't mow them down on purpose. If proof was brought to light that showed my relative walking out in front of him, then that was my relative being a suicidal tool. If evidence came out that the guy was drunk, or drove at them laughing maniacally, then I'd tell the judge he pleads guilty there and then.

Sounds like a job for Sam Fisher...

Seriously, I personally would represent him to the best of my abilities. Though, if I lost the case it would be very easy for the defendant to appeal the courts findings based upon the conflict of interests in me.

this is the most unrealistic situation that could ever happen....I believe that it is more likely that vampires and werewolves would come out of hiding on the same day aliens come down and start demanding to see our leader then the scenario that you just presented ever has a chance of happening.....

I can't believe that any civilized country would not have some kind of law against this. Not only that I find it hard to believe that any job would force someone to do something like that or face termination/corrective action.....

I am all for hypothetical situations but...not ones that could never happen because of well established facts

I'd defend him, though I would stipulate that he owes my family damages for emotional damage and funeral costs, all that other stuff.
