Is it just me or was that wholly unnecessary? Not only is that sum far too large considering what they did, but sure the person will simply claim bankruptcy and void the payments. So they wouldn't gain much money from it, and would pretty much ruin this womans life. Well done blizzard.

Blizz. Bit over the top there lads. Just take the servers off her and make her do the tea and biscuits down a blizz headquaters for a few months you know? I mean, c'mon, 88 million is just mental.

Don't you wonder if current owners of other private servers are silently shutting down their operations? Or there are people stubborn enough to risk a suit like this?

Well, I don't know how many private servers are out there, but I imagine Blizz will only bother to get legal on people making money from it.

As for people continuing to run them after this high profile case, we get a couple of people a year utterly destroyed in court for minor music piracy, and it doesn't seem to put off the other 18,000 people on that same torrent, so I'd say ..probably not.

She made just over 3 million profit from what amounts to theft, copyright infringement and fraud and people are wondering why Blizzard hit her as hard as they could? Yeah I agree, poor woman and all that but really when you're making 3 million illegally you kind of forfeit your right to sympathy.

Edit - Also we don't know how much warning she had from Blizzard before the lawsuit, my guess would be she had plenty of warning.

I don't disagree on the Blizzard hate, but that's kinda beside the point. It was a illegal server after all. Blizzard had every right to nail her.

This woman deserves no sympathy, and Blizzard deserves no hate. The reason it is so high is, first of all, if you are selling something at a yard sale, logically, you would start out asking for the absolute most you think you could get for it, expecting the price to considerably drop through negotiation, Blizzard, or rather, Blizzard's lawyers, did exactly this, the only problem is, the customer was apparently brain dead and took the first offer, by this, I mean, she didn't show up to court and contest it, like Blizzard no doubt expected, so the judge awarded the full amount. Also, the 88 million may seem excessive, but it at least has a logical backing, because in the most extreme case, Blizzard theoretically could have lost the amount, though it probably wouldn't be that severe. She dug her own grave, illegally giving Blizzard's product for free to over 400,000 people, and raking in 3 million in profits for herself, and ignoring the C&Ds. Besides, even if you still somehow want to blame Blizzard for being excessive, the amount is totally inconsequential, because even the most reasonable amounts would leave her bankrupt, I think it's save to say that if she made 3 million, Blizzard probably lost at least close to that much due to her server. After she forfeited the illegal profits, she would be staring down a several million dollar fine, which would almost definitely cause her to file bankruptcy. Perhaps I'm a heartless bastard, but I honestly can't see why anyone would have any sympathy for her, seeing as the entire case was avoidable in several ways, and could have been significantly reduced as well.

It's not like she's ever actually going to pay that amount. She'll do one of several things:

1. Appeal and damages will be in the thousands.

2. Go to Mexico, start a new life.

3. Commit suicide.

Or Blizzard is just making an example and will forget about it. Because if you're Activision-Blizzard, $88 million is pretty forgettable.

IMO, I'd go with #2, and if that failed, #3.

Making $3 million off of some one else's work by taking money from people that could have spent that money on the legit product: VERY VERY VERY bad.

Taking $85 million from that person as punishment: Worse.

Just make the punishment twice that of which was earned ($6 million) and lawyers fees and call it good. It's fair, and it's a deterrent. Most people playing on a pirate server wouldn't have paid for the legit version, so there isn't much argument that Blizzard loses customers to pirate servers, but if you end up making up to or even over $1k for hosting a pirate server then something is going wrong. I'll even accept some one accepting donations to keep a game running, but YOU SHOULD NOT PROFIT from it. $3 million is obscene, and this person does deserve a *****-slapping. I just think that this is far more than a *****-slap. It's a *****-slap, a curb-stomp, a dragging, and two shots to the kneecaps before putting her in a coffin and burring her alive.

Had she showed up in court, the fine would be much lower, however, it doesn't really matter, she'd be filing bankruptcy with a reasonable fine just as quickly as with a somewhat overzealous fine.

And my bet is people who play on private servesr also play on official servers. private servers seem to me, judging to comments on videos from its game play, an alternative, a way of trying what if we changed this and that in the game. I see them like WoW mods. But I could be wrong.

The micro-transactions were stupid. I can't believe they thought they could get away with that.

I don't have a problem with small private servers for groups of friends that own a retail copy of the game, but having a big private server and making money off of someone else's work is completely wrong.
