The title says it all, but here's a link

Basically, a judge found the ban was unconstitutional.

Personally, I am pretty glad they've done this. It's a victory for civil rights and just generally great (speaking as a brit).

Thoughts? I know you're all reasonably enlightened so I can't imagine much hate for this news.

I'm American, and while I generally dislike the Federal government telling the states what to do, I support this, as it was a breach of the constitution. Now, what's more important, is that people need to realize that any definition or tax breaks for marriage, by any government under the U.S. flag, is unconstitutional.

Calling the opinion of supporting gay marriage enlightened is presumptuous, still, I'm happy knowing there are some happy couples out there now.

Still, I've always had an issue with Judges just being able to deem shit people have voted on as unconstitutional, be the masses wrong or right.

In what way are tax breaks for married couples unconstitutional?

I'll start my celebrations when the appeals are all said and done. Also, in before someone brings up the terms "judicial activism" and "legislating from the bench".

Nowhere written in the constitution is the government allowed to do such a thing. And there is no "do what is necessary" clause regarding tax breaks, or marriage.

This is good and still very interesting (if it goes through of course), if banning gay marriage is declared "unconstitutional", then it would become legalized throughout the whole country.

We live in a republic, my misinformed friend. The United states is not a democracy. Witch is better in my opinion. This way, civil rights are protected.

Props to this response. Totally agreed; this thing will get argued and fought over for the next 3 years and ultimately it'll likely get overturned and the ban will be reinstated.
Not that I'm a fan of that outcome, it just seems what will be the most likely to happen.

Do keep in mind, not all that long ago, the "majority" believed that an interracial marriage was an abomination and that black men and women had no business voting. Hell, I'd be willing to wager that in some areas (even states) such opinions could very well still be held by the majority. The ability of the courts to overturn unconstitutional laws is a vital part of our interconnected and interdependent governmental system.

Nice to know California can change for the better. And I always jump for joy a little inside when people are afforded more freedoms to be with the people they love in the way they want.

That said, they're probably going to find some way to destroy it anyway. This is still America after all.

Also, before anyone starts crying "activist judge," the judge who tried the case was a CONSERVATIVE appointed by the Elder Bush. Such was the compelling nature of this case it caused a conservative to come down on the side of gay marriage
