So get this, my fiance's brother is a Senior in high school. Hes admittedly had a troubled past. However he has been trouble free for over 2 years now. Here is the REAL story.

Tom *The brother* has a girlfriend her name is *Tiff* Tiff has this friend named *Ashley* Tom likes Ashley as a friend, no more no less... Ashley is crazy over him. And I mean crazy, 15 phone calls a day constant attempts to be close to him kind of crazy. So...4 days ago there was a party Tom, Tiff, and Ashley were all there. Everything is good no problems, party ends.

Ashley needs a ride home. Tom offers, Tiff is already dropped off *order of houses..it made sense*

Ashley needs to use the bathroom, so they stop at Tom's house first. Ashley comes onto Tom...Tom turns her down. Tom brings her home...the end?? OF COURSE NOT THIS IS HIGH SCHOOL!!!

Next day roles around, Tom has a paintball tournament. Ashley runs into Tom *THIS IS THE IMPORTANT PART OF THE STORY* Ashley asks " Whatcha doin today?" Tom responds "I'm gonna shoot some people." In reference to his Paintball game. He also held up his paintball gun and mask while saying this. They talk for 5min, day continues. Around 6:00 that night Cops show up at Tom's house, he gets arrested for "Threatening to shoot Ashley" and now The school wont let him Graduate.

He has come....SUCH a long way for this. When you live the life he did at a younger age, graduating or ACCOMPLISHING something, is a much bigger deal to him than you and me. That being said, There is no proof, there is no one BUT her saying this, and to top it off there are witnesses to this SAYING it didn't happen.

So....Is this right??? Let alone Legal?????

Seriously, this is one of the most convulted stories I've ever read.

Granted, if what "Tom" says is true, they can't stop him from graduating, but what do I know. I'm just a nameless person on the internet.

in all seriousness I don't think the school can do that but it's america so i could be wrong xD That ashley girl seems like an idiot and it come down to her word againest your brothers were there any witnesses when your brother referred to shooting some people if so she's screwed for wasting police time :)

OP: that story is... well... strange... but no the whole thing is a misunderstanding and *tom* should tell the cops he was talking about the paintball game and then get testimonies from his victims.

Indeed they cannot stop him graduating over that. It wasnt a school issue.

Although if he has a replica firearm paintball gun he might get screwed with the shooting threat. If it looks like a regular paintball gun then he might be ok.

I know saying that you are going to "Shoot people" is not the best way to put it but come on. In a painball game it must be pretty obviouswhat he is doing. I think this Ashley needs to be slaped with some common sence.

I think they have to let him graduate surely. It was a misuderstanding and should be cleared up easily. Then again maybe the laws are different here. I hope this clears up well for you.

EDIT: yeah I just read this somewhere above me, did the painball gun look like a real gun or a paintball gun?

That girl needs to go to jail for lying to the Police, jeopardizing his education, being a *****(If that were against the law i would be a happy man) and defamation of character(how the hell is he going to get a job if everyone thinks he went on a shooting spree)

What's done is done. He should be able to get a diploma after it's all cleared up with the cops. School is dumb for witholding it, but this is a good learning experience for him - should document and distance yourself from crazy people.

Anyway, There is no proof he said this to her and you should try to trap her in a lie of some sorts.

Yes, they can prevent him from graduating. Yes, he can probably sue them for preventing him from graduating. But the best option is to tell them to go fuck themselves, drop out, and just get a GED.

The school can't do anything unless the police charge him, and the police can't charge him because:

a. They don't have any evidence of a physical, lethal weapon that can shoot things. (and paintball guns don't count, to my knowledge)
b. Their only testimony is a standard HS teenage *****.
c. They can't use any priors against him.

So he should be in the clear once the cops let him go, and should be able to graduate, because the school can't use his little fling with the law as an excuse to not allow him to graduate. All he has to do is not allow the police any excuse to keep him. Tell him to get a lawyer if he needs to; he might seem guilty at first to all his friends, but truth be told, cops know how to press down on people and make them think they're guilty when they're not. He can't give them any wiggle room.

Every story has two sides. I wouldn't trust something I heard from a friend who heard from a friend, and especially not a story from the guy who is being prevented from graduating-- 100% of the time High School students think they are in the right when it comes to matters between themselves and the school.

It doesn't sound like a very valid reason for not being allowed to graduate, which makes me suspect your fiance's brother was lying. Add in the bit of gripe about the silly relationships and it sounds even more like a story a kid in HS would come up with.
