Pretty sure if you get arrested, you wouldn't be in school to graduate this close to that time. So yes, it's entirely possible and the most likely thing, unless you do alternative school.

If that's what happened then it's bullshit and he should definitely graduate.

He may have excluded some parts of the story, and there might be something your missing, but as I understand it he should be in the clear.

Tom and/or his family should sue the police for wrongful arrest, someone accusing someone else of something cannot be allowed to be enough to arrest a person on. The cops should have done SOME investigating before going off half-cocked and arresting someone based entirely on someone else word. What the hell is this country coming to?

In reference to his Paintball game. He also held up his paintball gun and mask while saying this. They talk for 5min, day continues. Around 6:00 that night Cops show up at Tom's house, he gets arrested for "Threatening to shoot Ashley" and now The school wont let him Graduate.

He has come....SUCH a long way for this. When you live the life he did at a younger age, graduating or ACCOMPLISHING something, is a much bigger deal to him than you and me. That being said, There is no proof, there is no one BUT her saying this, and to top it off there are witnesses to this SAYING it didn't happen.

So....Is this right??? Let alone Legal?????
It has no legal basis, and they will cave under the pressure, but threats of legal action must come from a competent and relevant adult (parent, guardian, advocacy group) and may actually require the filing of a lawsuit or two - one against the school, one against the person who made the story up.

Had a friend whose daughter was accused by 1 person of calling in a bomb threat, and they expelled her forever - meaning she would have to find a new school, until her Dad threatened legal action against the school. There was no proof except the accusation. To add to that, the accused and accuser had a history of problems.

Better yet, talk to a lawyer. I don't think they can hold his diploma but they can stop him from attending graduation, but I don't know anything about what that particular school's rules are.

Really, well fuck, I recommend legal action for your friend. Stupid shit like this is the reason we have lawsuits.

That Ashley character might be a vindictive little girl, but she would get a cookie from me for that stunt. That is a class A way to get back at someone, regardless of the fact that Tom totally did not deserve that if that was what actually occured.

I got that out of the way? Ok, good.

This is quite screwed up. I hope your friend gets out of this, because this has to be one of the mre screwed up stories I have ever heard, and i've heard alot.

Schools can prevent you from attending graduation for any number of reasons. "Not being allowed to graduate" doesn't mean that they won't be getting their otherwise earned diplomas, it may mean they just can't participate in the ceremony. I know a few people who weren't allowed to attend their graduations for infractions as minor as making an ass of themselves during a trip or at prom.
