Bigger question, why is the guy who assaulted her still on a high school sports team? Unless they had a really, really flimsy case that is bullshit.

They should have just let the cheering issue slide, and they shouldn't have demanded compensation. They already look like the villain to the general public, they're just making it worse.

I don't know how I feel about her suing. I think it was bullshit that they kicked her off the team, but i'm always really iffy about suing the City/State/Government.

Well, it's Texas. Cheerleading isn't considered an actual sport, they just finished up a court case and huge waste of taxpayer money figuring this out, so she wouldn't be protected when accusing the STAR football player of rape. The STAR football player gets the protection because he is more likely to win the school recognition than a lousy cheerleader. That and in Texas high school football is almost a religion of it's own.

Sure she has the right to free speech. Everyone does. People just don't have the right to not perform the responsibilities of their roles (jobs, sports teams, etc) and still expect to be part of the team.

Why would freedom of speech extend to a voluntary activity you put yourself in? Just because you have the right of free speech doesn't mean you have the right for it to be free of consequences. You have the right to call your boss a fuckhead in the middle of a business meeting, and you would have no recourse under free speech when you were fired. The cheerleading team would have been a voluntary association - if she had been yelling out racial slurs and offensive language rather than keeping silent, do you believe the team still shouldn't have the right to remove her?

A lot of people in this thread have a fundamantal misunderstanding of how the law works.

And how US freedom of speech works. I'm Australian and it appears that I know more about American law than most people in this thread do.

Gotta say, it ought to be nice for opposing teams to be able to bring in signs that say "Beat the RAPISTS!" for the next ten years.

I know people are going to disagree with this but here it goes anyway.

I can understand how the school/courts could see this case as 'frivolous'. This guy was let back on the basketball team after the initial incident. Chances are good that this wasn't a big secret. So from the schools point of view, she should have realized, that at some point being on the cheer squad she would have to cheer for the basketball team and through that, the person who assaulted her. With that train of thought, she had several choices that she could have done to avoid the situation at the game. She could have talked to the coach to see about not participating during basketball games and if that wasn't an option she could have removed herself from the squad. So in short she had ways to avoid the situation and as far as I can tell from the story, she didn't even attempt any of them.

Also, if the person who raped your daughter, was back in the same school as her, wouldn't you see about moving her to a different school?

I just read the rape charge was dropped after he got 2 years of probation, community service and went to anger management. And being a cheerleader means she has no free speach rights and what sounds like no humane rights? The fuck is wrong with people these days!

I can understand - and largely agree with - the court's reasoning of it being justified to put her off the team for refusing to perform the tasks required of her, but terming the lawsuit, whose motives are quite understandable, to be "frivolous" and ordering 45.000 $ to be paid seems unjustified and disproportionate.

The school could have handled the situation much more elegantly, and that should've factored far more prominently into the decision of whether or not to award them costs.

I can understand why the supreme court wouldn't take the case but its fucking crazy shouldn't couldn't get a fair shot in another court in texas.

Man, I'd raise a whole stink if I were her.
