heh. Stupid little tosspot does not know that you cannot just bring a class action lawsuit, I believe that the US judicial process requires that you receive consent from a judge that a class can even exist. Idiot gamer twerp can look for a lawyer if he wants, but no one is going to touch this on contingency and I seriously suspect that any judge is going to read the terms of service and the attached code of conduct and bin the case on the spot.
In just reading the TOS for less than 2 minutes I noticed:
"In addition, trying to avoid a temporary suspension by creating alternate new accounts may result in a permanent ban on the new user account and a possible escalation of punishment to the original account and all related accounts"
"Don't impersonate, harass, or defame Microsoft employees, moderators, or staff members."
"Microsoft reserves the right to immediately terminate or suspend a user for violations"
And that is without even looking at the penalties for using mods to interfere with games. All I see here is a pathetic little basement dweller with no concept of the adult world and an over-inflated sense of entitlement.

Thats probably why I enjoyed runing a CS server for a while. If you pay for it, you can build/admin it the way you think it should be.

TBQH, The Pro deserves a raise. He may have been a bit out of line with his tone, but it was warranted in that case.

I feel quite bad for The Pro, he's bound to get a lot of stick for this, both from Microsoft and the general public. People will likely polarize to either end of the argument and it may take him a while to live this down.

I have a serious issue with this banning. After watching the unedited vid and hearing what the little snot said yes I would like to see him banned. And then kicked in the teeth. However I don't think he should have been banned. I don't agree with mods being online looking for little shits like this. Mods seeking and destroying hackers and cheaters go nuts. I have no control as a player to combat hackers and cheaters. I do have (as do all the other people on XBL) to deal with annoying shits like that without needing my mommy to fight my battles for me. It is too risky for me to think otherwise since it could get out of control in no time. Where does it end? If I am in a game with a mod and call someone a prick or say "fuck" and potentially get banned because the mod doesn't like my voice. I am already scared enough every time I fire up my 360 (RROD) but now I gotta worry about throwing 60 bucks out the window because I don't mind my Ps and Qs online?

I immediately new it was fake when he said his "Capture Card went crazy". Lol yeah right, capture cards don't just "go crazy" and fuck up the audio. It was also obvious by the tone of that kids voice when he said "can I ask you a question sir". I'm glad the little shit got banned, I'm tired of hearing people like that on Xbox Live.

EDIT: God I hate when little kids use the mic. There are a few exceptions, but it really pisses me off to hear high pitched kids screaming about how beast they are. If I was that mod he wouldn't have had a first warning soons he started insulting me; ban.
I agree that the potential is there for it to get out of hand. But the grounds of the banning were not the 'use of language', it was the user's blatant ignorance to the Live terms of use. He'd been temporarily banned for modding, then created a temporary account to get around it (which grants access of the perma-ban). He then proceded to mock and provoke The Pro (more breach of terms) while re-applying the mod in defiance.squid5580 said:

Apparently the kid was breaking the Terms of Service by insulting and harassing a Microsoft employee. Another note, the actual hacker (not the foul-mouthed kid) being banned for modding and hacking in previous accounts seems to have conveniently forgotten that the ToS allows Microsoft to ban people and all of their accounts based solely on past conduct--though, naturally, this would be rare seeing as how one would have to be a very persistent and irritating recidivist to get threatened with a true multi-account permaban.
