At a glance, it seems silly, but it's fair.

If you injure someone because of your stupidity, you should pay for their expenses, even if it did kill you.

You know what strikes me first in this whole story?

Not the fact that a dead person was sued for a hospital bill that her detached body part caused to a bystander when she was violently killed.

The fact that the wounded bystander has a significant hospital bill to take care of at all.

Good going, yanks! Yep, socialized healthcare is the mother of all evils and the situations that force these kinds of court cases are not only perfectly rational but a sign that your healthcare is doing it's job.

Meanwhile, I'm looking at my 15 euro bill for three days stay at a hospital, minor surgery and associated medication, aftercare and few hours of physiotherapy to get used to my new cast and walking sticks for moving around, after my leg got badly broken through a freak accident.

Yeah, got to side with the majority here, Government run healthcare is not the same as wiping your ass with the constitution and selling the Whitehouse to China. The USA will not immediately become communist if people no longer have to choose between food and medical bills.

Sadly tho, I read a headline, tho haven't had a chance to follow it up, that the NHS is struggling in the UK because so many people are now suing for medical reasons.

To me, if you go in expecting to have both legs amputated and they save one, but lop off a finger, you shut your face and you thank the medical team, you don't immediately get on the phone to the last bunch of ambulance chasing lawyers to appear in the ad break on TV.

I'm going to sound 80 here, but I'm sure about 20 years ago there were far fewer lawsuits, and far fewer of them were money orientated. If I could eradicate something, high on the list would be these armies of law firms pretty much begging you to get in contact if you've had an accident anywhere and think you could blame someone.

In short, I don't believe it's her suing either, it'll be the aforementioned ambulance chasers, or her medical insurance, dancing on someone's grave to earn enough pennies to not lose their monthly bonus.

This 'person' has no concept of compassion, perhaps she should sit and think about if that was her son who had just lost his life; regardless of the situation. Also, his family who have lost a loved one and all the pain they will have to endure. Bones heal, flesh knits back together, but you can't bring lost loved ones back.

Once again it goes to show monetary gain is more important than life.

I understand the practical liability side but still can't help but picture a lawyer coming up to the mom and dad during the funeral and saying "sorry for your loss" but before the parents can say thank you he laughs and goes, "oh not for your son..LOL for the lawsuit. Have a nice funeral"

It was the kid's own bloody fault, yes, but it's a nasty way to loose a relative, and if you have a modicum of tact in your body, you'd at least let them bury the poor chap before demanding they show up in court.
To be fair, if they were better parents, their kid wouldn't be dead. I don't know about your parents, but mine told me to look both ways for enormous loud objects before crossing things. At least natural selection has ensured that this kid wont grow up to have kids even more moronic.

Also, being a bigot doesn't help your argument.

Really? You are going to go down the, "Bash America," road here? The facts is this case are pretty cut and dry.

It's not that hard.

A woman was standing at a train station, minding her own business, when she was struck and subsequently injured by a flying body part/body parts moving at a ridiculous velocity.

Her injuries were caused by negligence of the 18 year old in question. She did nothing to deserve her injuries, and she had no way of predicting that such an event would take place.

Besides... She's not suing (note the correct spelling here) the parents, but rather she is suing the dead man's estate - claiming compensation for injuries as possibly for lost wages as a result. She couldn't go after the parents even if she wanted to.

You can't honestly tell me that nobody ever sued for loss of wages or injuries sustained due to the negligence of another in your country can you? I don't think so.

You don't know how insurance works do you? When one of my mom's employees children got injured in a car accident caused by another person they had to sue the person for the insurance money. Not because the person didn't want to pay but because the insurance company wouldn't have otherwise.
Maybe with your insurance companies. I've claimed insurance in the past for the faults of others, and it's been a relatively painless experience. Although you end up with horror stories like this, it's not as if you always have to sue to get compensated.

She shouldn't need medical care, she is 58 not 90. If you can be injured by that it is your own damn fault for not taking care of yourself. This whole 'we have to look out for useless people who haven't taken care of themselves' idea needs to be full on or off. How can people be so anti- things like unemployment insurance/welfare but not this stupid woman.

She isn't suing him, she is suing the estate.

She is fully entitled to. I see no reason why she should be forced to be stuck with thousands of dollars worth of medical bills because some retard thought he could outrun a 70 mph train.

This had me in stitches. I've never laughed so hard in a long time. Call me insensitive but somebody sueing somebody because their son had the audacity to insta-gib when hit by a train and therefore a stray chunk of person collided with the offended party, is such dark humour but still...

Please tell me I'm not the only one to find this funny and disturbing at the same time?
