Even if sony were loosing profits, as long as their profit margin is going up, they will continue to release new games. This fact I loathe dearly.

Well, if Sony went out of the raqce, I'd assume Nintendo would balls up and take on Microsoft. Well, that or Microsoft and EA games will become an individual monopoly each, and any non-indie dev team will be thrown out of the market.

I don't know if anyone would take Sony's place.
However, I don't think the Sony are giving up anytime soon...

If Sony goes down, it won't be immediate. There will definitely be a PS4. The question is whether or not they'll be able to remain viable beyond that point and that will depend on a number of factors.

I don't see the Playstation tablet being a big hit, and the NGP looks like it's following the same failed blueprint as the PS3 launch-power over function/price. (Not to mention its size for a portable; that's going to be a factor.) There's no telling how much future legal battles will hurt them and it's impossible to tell whether they've lost current customers or new sales as a result of this fiasco.

Bad business strategies, lots of products on the market which either fail or underperform, major legal battles, bad PR... It's conceivable that longterm they could bleed out and be forced out of the race. I think they'll be able to recover if they keep most of their current base and sales continue at the pace they are now. The wildcard is whether or not they'll adopt a smarter overall strategy as the only thing that can truly kill Sony is Sony.

I don't think a hole would appear, there isn't much difference between the 360 and ps3 when you get down to brass tacks. They both do the same things and suffer from the same restrictive oversight.

Nintendo would probably pick up the slack with a more hardcore oriented system similar to what they're coming out with next year. There's hardly enough difference between the 360 and PS3 to justify competition but Nintendo is different enough to provide some variety. The next time a third competitor would surface it would probably be a cloud-based service and it could very likely wipe out both Nintendo and Microsoft if they don't follow suit. (This is talking about ten years down the line.)

They're not liable.

Sony's lawyers are smarter than you and have planned for this eventuality.

Edit:

If you mean that they lost your credit card number, that hasn't even been confirmed yet. If they have, they haven't told the bank. And that means they're in a shit load more trouble than a couple of class action suits.

They'd be done for fraud.
I did say "if".

I'm aware that any terms of service I agree to attempt to free the company from all liability. That does not mean it would stand in court, as I would imagine a company must behave within reason or be held accountable. To put in an ridiculous, extreme example, if a thousands of words long terms of service you agree to, includes a clause giving your first born to the company, do you think that would be enforceable?

Now, I'm no lawyer, and I'm not saying they will be made accountable. But whatever the terms of service say, they are not a unbounded "get out of jail" card.

Atari, I'm hoping.

Sega has stagnated with the Sonic franchise...though they're working wonders with the Total War series.

I'd really like to see a third party step up. Maybe Clover studios, or what became of it anyways, since they shut down.

My big q to you people is who do you think might have a chance to get into the race and try and recover the usual third front?
Apple would be an interesting contender, it would totally be a cheaper(slightly), game oriented version of the iPad with the ability to connect to any modern screen.

One of the major motion film companies might try now that they've seen game profit eclipses movie profits.

EDIT: I don't think Sony's done for, at worst they'll go the way of Sega and rape their established mascot/icon ip, falling out as a console maker.

I think Appple would(should) take a stand and get into the market. quite frankly i am seriously surprised they havnt already. the market is well and truly right up there alley in things they actualy do good. there PC market never was great, and more niche based for creative fields while MS always centered towards office/casual market. console players are more likely to use an Iphone, Ipod, or Imac by choice than a android/palm os, basic MP3 player, windows based notebook/desktop.

Apple got into the MP3 market in the begining and most people asociate MP3 players with Apple products, they hopped onto the cell phone market a bit late but the first iphone gained a lions share of the market(PDA Phone) very very quickly and is not really being challenged a bit by google while palm and ms are left behind. then they entered the tablet arena.. well they now pwn it.

apple has a proven track record for keeping a secure network with i tunes, the PC market they hold is more geared towards creativity aplications so it would be easy for them to create an OS loosely based off the Iphones and the Mac OS... kinda like the Ipad, but geared to plug and play games mainly with everything else less but still there... as in Mac PC capabilities, using mac apps, KB/mouse full support, actualy giving you console players the computer side of your console rather than a locked OS.

But then Again i think MS should make a new gen console/pc hybrid OS as well, laptop type PC with docking station thats hooked to TV/surround sound, robust enough to run PS3/360 titles(easy as), yet small enough that it can be undocked and taken anywhere... oh wait thats a laptop... sorry just need a better OS to do all the installs quickly and easy... oh wait that already happens... umm ok win 7 now, just need game devs to give complete controler support from the get go! like Portal 2... ok thats all lulz because its true, theres a complete console out already!!!

anyway back to subject... I thin apple should/would fill the void. nintendo has kids and family, MS has hardcore and adult, Apple could fill the middle ground as they are wont to do anyway.

No...one? Why does there have to be a third? A big 3 way war is new really. Used to be one vs one. Sega vs NES/SNES, N64 vs Playstation...
Though I guess Apple. I dont want them to, and would hope the fail, but they seem the most likely to try at this vulnerable moment.

simply because of the amount of time, they'd be working against Xbox and Nintendo, both of whom have more money, existing market share, and existing reputations with both consumers and game manufacturers, both of whom know what the consoles can do, and what they want from them.
Replace the word Xbox with Sony and you have Microsoft before the release of the Xbox. One gen later and many people prefer the 360 to the PS3, even plenty of self-proclaimed PlayStation fanboys have made the jump, myself included.
This is true but the first xBox had a one up on both of those consoles in xBox live. The online on the original xBox was like nothing we had seen before except on PC.
Done first on Dreamcast.
Ok, you're a bit flippant.
I didn't say xbox did it first that's totally irrelevant. The Wright brothers flew first but they didn't make commercial air travel.
I said xbox was the first to make online multiplayer as good as the PC, or at come close.
The dreamcast's internet was an add on they did very little with. The xbox used online to redefine multiplayer FPSs on consoles.

Honestly if Xbox (or Playstation if microsoft were in a similar bind) completely takes the console market it would be fine with me. There is no real point in having more than one console out on the market. Other than starting fanboy wars on the internet...

anyone seriously thinking this is a possibly?
Not at all, but it's fun to use your imagination.

Hmm, perhaps a Sega console with full Steam support?
i hope your right but i think a few people may just believe this I'd say more but i think this is as much as i can say without the mods hitting me with a warning or something

the worst thing that could happen is if EA created a console.

why you ask? because they would completely dominate the market.

think about it, if they only make their sports titles exclusive to their own consosle only, that's millions of average joes there that they will get to buy their consoles.

then of course they also have less best selling, but still exclusive killer franchises they could sell:

need for speed, mass effect, dragon age, dead space, battlefield...etc.
