I think it's more about them not having any right to do so since Megaupload wasn't putting said illegal files up. (And not all files were illegal, some businesses used them to transfer files easier) Hell they're going after everyone involved with megaupload even the graphic designer. If Anonymous had really shut down the DoJ, there'd be a pretty big crisis across the country, seeing as any high level judicial stuff wouldn't be able to function what with most legal information being digital now.
