Alright, time for some facts. There are a FEW exceptions to the first amendment. Libel is one, slander is another. i.e. what the Phelps' got sued for. That's a valid charge. Disorderly conduct is the first step in the direction of a police state. What you did is fucking stupid, and rude, but NOT illegal and they have nothing on you.

PS: Yes I am a Conservative.

PSS: No I don't think what he did was right, I just know that there's nothing illegal in it and he is being given a bullshit charge.

Final Thought: No I don't watch Bill O'Reily or like him.

Final Final Thought: You should fight it, if only to show that you won't accept having your rights stripped away. At least make an attempt and when all else fails, make a public spectacle. Make sure people KNOW, there will be people like me protesting and demanding a change, something that needs to happen. When I was a Freshman in High School we could be arrested for swearing in School.

Final Final Final Thought: If anyone is familiar with the Ciavarella corruption case, that is my county and he is the reason we could be charged like that. It's just a prime example of when power hungry cops/politicians etc. run freely and no one does anything about it.

So, evidently the OP thinks he has a Constitutional right to be a dick to people who put their lives at risk, for little pay, every fucking day. I am not a cop, I am not related to any cops, but I sincerely hope that they throw the OP in jail. It would be a good lesson for someone who is evidently, extremely arrogant. That's me being nice, by the way, my personal rule is that smart-mouthed little snots need to have the shit beat out of them to teach them humility.

The bad news is that although you will pay a small fine or something else trivial, the charge sticks around on your record for a while which can really screw you when looking for a job.

Sorry to say but you kind of deserve it. If you hadn't been a smartarse, you wouldn't have been charged. You should have given your ID, make POLITE conversation, thank them and leave. They're only doing their job.

Shouldn't have to. I can call a guy in the bar and asshole without getting arrested, why should cops get special treatment? I can understand giving out harsher sentences for actual crimes committed against cops to deter further crimes against them as they are at high risk for those actions. Unless the OP is not telling something he should not have gotten the citation.

I too have gotten a citation when I shouldn't have. I learned not to accept the judgment of an asshole judge when he obviously was not being impartial. Not even my words, the word of a member of my bases legal office when I brought it up with them. They took care of it with a few letters by the way.

It was for Public Intoxication, I was drinking in my own yard. Long story short the neighbor called the cops, and then while I was there in handcuffs told the cops that I was their neighbor and was not the reason she called them. The cops gave me a citation and told me they had to drive me home. Idiots. I let them know as much as well. Didn't get another citation.

The judge I had to see would not even let me finish explaining the circumstances. He simply cut me off and said "The police wouldn't give you that ticket if you didn't deserve it." That was it, no affidavits where filed, nobody showed up to testify. I was guilty simply for being there. That is not how the legal system is supposed to work in the US. Which was why I went to the legal department of my base. Which brings me back to the start of my tale.

Simply put, the cop abused a blanket infraction simply because he was annoyed. You might be able to bet it if the judge is willing to listen, and will beat it if you get a lawyer.

Is that where the local judge was sending juveniles to a "For Profit" (Should of been a red fucking flag right there) detention center in return for kickbacks?

Legally you cannot get PI on your property. That would make it "Private Intoxication". You can get as hamered as you want and run nude circles in your yard (provided you have a fence) and they can't touch you. Technically.
Did they trick you into stepping onto sidewalk or street? They do that alot.

A good analogy for the way law works is you can swing your fist as far as the next person's face. You're welcome to say whatever you like as long as it doesnt bother anyone else. Laws/constitutional ammendments are in place to protect everyone not just you.

Ohhhhhh yes, I went before him myself. I escaped with no jail time because I had a laywer. I was arrested for "disorderly conduct" (I got into, oh heaven forbid, a FIGHT! With ANOTHER GUY! In 7TH FUCKING GRADE! It's not like adolescent boys ever, you know, get into FIGHTS or anything.) No one even got hurt. Just a minor fight that got broken up before I got fed up with his ass and kicked him through a wall (I'm a martial artist, have been for years...so I was putting up with him hoping I wouldn't have to tear him in half but was about to when someone stepped in). The best part is he was made out to be a victim. I wasn't a victim of Ciavarella directly but me and everyone else in the area want his ass regardless. I hate him for what he did to my buddies (again, got into fights...one of them is in placement and hasn't seen his mom in years) and I hate him for turning my later Elementary School and all School afterward into a police state fascist shit hole. But shit like that is WHY you can get arrested for stuff like this.

Yeah, the OP did something stupid, rude, arrogant, and he shouldn't have done it. But he did NOTHING illegal. That is the problem. Challenge it, win, make a stink. You've got to for the sake of the country.
