Alright, time for some facts. There are a FEW exceptions to the first amendment. Libel is one, slander is another. i.e. what the Phelps' got sued for. That's a valid charge. Disorderly conduct is the first step in the direction of a police state. What you did is fucking stupid, and rude, but NOT illegal and they have nothing on you.

PS: Yes I am a Conservative.

PSS: No I don't think what he did was right, I just know that there's nothing illegal in it and he is being given a bullshit charge.

Final Thought: No I don't watch Bill O'Reily or like him.

Final Final Thought: You should fight it, if only to show that you won't accept having your rights stripped away. At least make an attempt and when all else fails, make a public spectacle. Make sure people KNOW, there will be people like me protesting and demanding a change, something that needs to happen. When I was a Freshman in High School we could be arrested for swearing in School.

Final Final Final Thought: If anyone is familiar with the Ciavarella corruption case, that is my county and he is the reason we could be charged like that. It's just a prime example of when power hungry cops/politicians etc. run freely and no one does anything about it.
Is that where the local judge was sending juveniles to a "For Profit" (Should of been a red fucking flag right there) detention center in return for kickbacks?

Ohhhhhh yes, I went before him myself. I escaped with no jail time because I had a laywer. I was arrested for "disorderly conduct" (I got into, oh heaven forbid, a FIGHT! With ANOTHER GUY! In 7TH FUCKING GRADE! It's not like adolescent boys ever, you know, get into FIGHTS or anything.) No one even got hurt. Just a minor fight that got broken up before I got fed up with his ass and kicked him through a wall (I'm a martial artist, have been for years...so I was putting up with him hoping I wouldn't have to tear him in half but was about to when someone stepped in). The best part is he was made out to be a victim. I wasn't a victim of Ciavarella directly but me and everyone else in the area want his ass regardless. I hate him for what he did to my buddies (again, got into fights...one of them is in placement and hasn't seen his mom in years) and I hate him for turning my later Elementary School and all School afterward into a police state fascist shit hole. But shit like that is WHY you can get arrested for stuff like this.

Yeah, the OP did something stupid, rude, arrogant, and he shouldn't have done it. But he did NOTHING illegal. That is the problem. Challenge it, win, make a stink. You've got to for the sake of the country.
Off topic, but are they still running that operation?

Legally you cannot get PI on your property. That would make it "Private Intoxication". You can get as hamered as you want and run nude circles in your yard (provided you have a fence) and they can't touch you. Technically.
Did they trick you into stepping onto sidewalk or street? They do that alot.
Strangely you don't even need to have a privacy fence in that city to run around in circles naked. The decency laws for that town only extend to lewd acts. So just sunning naked on private property (even your front yard) is fine, make a suggestive gesture and it is off to jail. Utah, makes you drink 3% beer, but lets you walk around naked - go figure.

They arrested me in my yard, I mean guns drawn, shouting at me to lay down. First time I set foot on the side walk was after I was arrested and in handcuffs. They responded to an attempted break in at my neighbor, not even a noise complaint. The lady was paranoid and it was her son trying to sneak back into the house. She made it a point to tell them I wasn't doing anything wrong.

And being a wise ass while he was talking to me and asking for an ID.

Charged with disorderly conduct.
I co-operated completely during the arrest. Gave him my information (albeit in a smart ass way).

I can beat this in court right?
You can try it.

And you will fail.

The most important piece of advice that I've ever been given was given to me on the first day on my Law course. "When you come into the police, there is only one name for the officer in front of you. He's not 'officer', he's not 'dude', and he's sure as hell not 'piggy'. You call him 'sir'."

TL;DR You were a prat. Go to court, kiss as much ass as you need to, say your Hail Mary's and hope the judge is feeling nice and gives you a minor fine.

EDIT:

No, sir, you're from NEW Jersey. I'M from Jersey, we have better cows then you. Our governor used to own your state, hence the name.

We can also run rings around the cops down here, most of them can't catch a reasonably fit teenager.

If you're going to represent yourself for the lulz, call the Judge an asshole too, then you can be found in Contempt of Court...

...then you can look him in the eyes and say "I have nothing BUT contempt for this court" [http://www.youtube.com/watch?v=gjAhTKsxf5Y#movie_player].

[small](it would also help if you could transform into a car and roll out of there).[/small]

No.... I very much doubt it. NEVER say anything untoward to a policeman because, let's face it, they're generally pretty bored (round here they are anyway) and they'll look to book you for anything and I mean - you just blatantly swore at him. What did you expect?

The first amendment is a double-edged sword though. Just as you are entitled to insult him, he is entitled to arrest your ass for insulting him.

Seriously, talking back to a cop was stupid.

Off topic: Yes. People are still getting arrested. Including this crazy ***** who brought me (at ten years old, at the time) to tears with threats because I wrote a letter to our principle objecting and questioning something that was in our handbook because I thought it was illegal for them to do. Then all Hell got raised because I questioned our Fuherer. Upon reflection I must say..."What the fuck?"

1. Utah is weird.
2. "attempted break in" = probable cause. Your rights went bye bye.

Nothing in there about hurt feelings being grounds for arrest.

Do we all know what it means to abridge something?

I was disrespectful and rude. That is pretty obvious.

But disrespect IS NOT illegal.

The issue is legality
If it was up to me it would be illegal, but it's probably illegal enough for you get a fine and some warning. What happened to the good old days when people addressed cops as "sir" or "mam?" Nowadays all these kids disrespect cops for no reason other than their egos and when we don't have authority anymore, we'll have anarchy. Anarchy is when people just go around shooting each other and taking whatever they want because they feel like it. We can just tell the cops -"Hey fuck off buddy, I have Amendment rights, can't you see I'm trying to rob the bank here?." Sounds great doesn't it?

This is probably a more interesting summary of what the judge will tell you later. Believe it or not, there are reasons we can't call cops assholes whenever we want!

I actually had my first police encounter a little while ago. Me and my mates were walking around at about 3 in the morning, hanging out basically, and as we were walking past our school, a cop car pulls out. We didn't get in trouble or anything, the guy just asked where we lived and what we were doing, but he was generally an asshole about it. Insulting cops is always a bad idea, because, as much as everyone hates it, they have the power. I doubt you're going to win this battle mate.

Nah, I was fine with them arresting me. They where doing their job, but once they found out that not only was there no crime, but that I was in no way involved they should have just released me, and not given me a citation. They probably gave it to me for being Mexican. I normally would be the last to scream racism and since it has seen such a decline in most places I would chastise others for jumping on the racism bandwagon, but this is Utah. I got crap all the time for being Mexican.

Okay, let me put this in more understandable terms. You have right to speak freely of your opinions, but you have no right to be an asshole, especially when you're insulting a person to their face.

Normally, someone will just ignore you because you're not worth listening to anyway. But a policeman? Well, he'll go right out of his way to make sure the legal system fucks you up the ass.

It's just desserts, pal.

The good ol' days of fire hoses and police dogs being unleashed on people who wanted civil rights? The good ol' days of city sponsored lynching? The good ol' days of police chiefs living in mobster pockets?
I think progress happened to those good ol' days. Just not enough.

Grrr, stole my line. I sent a similar quote to a guy in our county who claimed having a nativity scene in front of our courthouse around Christmas was unconstitutional. People LOVE to claim something is their "right" but most don't know what the constitution actually says half the time. That's why people like me are around. Once again, I know some folks think he deserves a fine. Even I do to some extent. But my dilemma is he is being charged with breaking a law that doesn't exist and his freedom is being infringed. That is something that can't be allowed, because it starts with one freedom and ends with them all. If cops want to be able to arrest/beat people for insulting them, they can go to China. A country where Christian Churches and other "unapproved" Churches get destroyed and the congregation brutalized by cops and rent-a-thugs. Freedom of Speech in particular is important, and I'm going to tell you why. Even in places that have most of the same liberties, there are still a lot of holes in said freedom. Like in Germany. Anyone who is familiar with the language is familiar with the difference between "du" and "sie". The latter is formal, and if you refer to a policeman in Germany as the informal version, you can get a fine because it's offensive. America is (suppose) to be the only place where you CAN get away with saying what you want to say. That's why I think the OP, while what he did was a dick move, needs to raise all Hell.
