That doesn't make it legal, but it does stop it from being theft. Copyright infringement is, I think, what you would be charged with.
It might not be theft but it's still not legal so it's a moot point really. You're just calling it by a different name.

Just because it's not called theft doesn't mean it's legal. If you were taken to court for downloading or distributing massive amounts of copyrighted material and when in court you said. 'It's not theft' I would like to see that hold up. Because call it whatever you want it's still not legal. As in that excuse won't fly you're still going to jail, therefore meaning it did not hold up in court.
