Only if you're willing to say that all movies, books, music and paintings are art can you say that all games are art. The act of painting is "an art" but the actual paintings are "art". I'm a little confused because you could say that the way you play CoD is an art. The way you hide behind cover and throw back grenades that you do better than everyone else is an art form in it's self.
But games are art. All games, even the crappy ones.
Art makes you feel something
Paintings have to do it on visuals alone
Books do it through narrative alone
Music does it through sound alone
Movies get to use all 3
Games can do it through any combination of visuals, narrative, sound, or play mechanics.

Concept artists, character designers, level designers, programmers, modelers, shaders, animators...if the result of all of this collaborative work from all these artists isn't a piece of art, then I don't know what is. I can understand that feeling, myself. I feel that a game can be created with the sole purpose of conveying an artistic experience; more often than not however, games are a mix of interactive ideas which includes some form of art -- and in the case COD -- superficial artistic direction. I think a better way of explaining what you mean would be to list the reasons why you think COD qualifies as art.
